18.01.2022 How does marriage or divorce affect a Will? While it’s easy to update a relationship status on social media, you may not be aware of the effect this has on your... Will. Marriage and registration of a relationship will automatically revoke a Will, unless the Will is made by contemplation of marriage. A clause to this effect must be clearly specified. If left unattended, the distribution of your estate will be determined by legislation and not your specific wishes. Unlike marriage, a divorce will not automatically revoke your Will. The Wills Act provides that any appointment or benefit left to your former spouse will be revoked upon divorce and the Will is treated as if your former spouse had predeceased you. The remaining parts of your Will which do not benefit your former spouse will still be effective. Updating your Will following a relationship change will give you peace of mind that your estate is not left vulnerable for distribution. This document replaces the previous Power of Guardianship, although a correctly executed Power of Guardianship before 2013 is still valid. Any one over the age of 18 can use an Advance Care Directive to record their wishes, preferences and instructions for future health care, end of life, living arrangements and appoint someone to make those decisions on their behalf if they are unable to do so themselves.
