17.01.2022 The 'duty of disclosure' is an incredibly important aspect of all family law cases It means that each party must provide the other with any and all information that might be relevant to an issue in the case. The duty is ongoing, and each party is required to update disclosure if/when their circumstances change. Some of the main information each party is required to disclose includes:... Income Earnings Property Debts Liabilities Any other financial resources you may have. If you suspect that your ex is concealing earnings or property, there are a number of steps that you can take to seek the information, such as: Issuing a request to someone’s superannuation fund. Conducting ASIC or Land Registry searches for property interests in the name of the person or any associated entity. Whether a party’s non-disclosure is intentional or accidental does not matter. The duty to disclose is absolute, and if you fail to comply, the Court may dismiss your case. In more extreme circumstances, the Court may issue you a fine, or even make the decision to imprison you To learn more about the 'duty of disclosure' in family law cases, reach out to us on (02) 4943 3988 during trading hours

11.01.2022 The last two years have really put into perspective just how quickly our lives can change. If you've been thinking about getting your Estate Planning in order, consider this your sign to do so! Estate Planning ensures that when you pass away, your loved ones are provided for and your assets are distributed according to your wishes. The process is made up of the following components: WILL ... A Will is one of the most important documents you will ever sign. It outlines how your assets are distributed and nominates a person, known as the Executor, to manage and distribute your estate after you pass away. POWER OF ATTORNEY A Power of Attorney is a document which allows you to appoint a person (the Attorney) to make financial and legal decisions on your behalf. ENDURING GUARDIANSHIP An Enduring Guardian is a person you appoint to make health and lifestyle decisions on your behalf, when you are unable to do so yourself. This includes decisions such as where you live, what services are provided to you at home, and what medical treatment you receive. For more information on Estate Planning and what the process requires, check out the latest blog post on our website, or reach out to us on (02) 4943 3988
