22.01.2022 Big thanks to Nicole McEldowney, solicitor from Payne Butler Laing, who represented the RSPCA brilliantly once again yesterday when Natasha and Wireless Putere pleaded guilty in Bundaberg Magistrates Court before Magistrate LAVERING. On 7 November 2017 an RSPCA inspector attended the defendants’ property and found that one dog was in excellent health with no welfare concerns. The defendant Wireless stated he had owned that dog since it was a puppy. The RSPCA found two other d...ogs on the property, Jasper and Boof. Jasper had access to water and limited shelter. She was in an emaciated condition with her rips, hip bones and spine protruding and easily visible. Boof had access to water and shelter but his enclosure was full of faeces. Boof was in a very underweight condition, with his ribs, hip bone and spine easily visible. The defendants stated that they did not own Boof or Jasper and that they had been left at the property at different times, Boof approximately 12 months ago and Jasper just under 12 months ago. The defendants claimed to have been feeding all dogs on the property but had never consulted a vet about Boof and Jasper being underweight, nor had they arranged for the dogs to be wormed. Boof and Jasper were both seized by the RSPCA inspector. They were wormed, treated for fleas and placed on a diet of commercially available dog food. Both dogs were returned to a healthy weight range within four weeks. The defendants were convicted in relation to 2 charges of fail to feed and 2 charges of inappropriate living conditions in relation to Boof and Jasper. They were each fined $2,000 each with 50% moiety to RSPCA, and ordered to pay $100 each for summons, $366 vet costs each, and $800 each for legal costs. The defendants received a 2 year prohibition order for all animals other than as approved. None have been approved. November 2017 photos of each dog are attached, as well as photos of their current healthy state.

02.01.2022 Shinina Price and Christopher Dummer pleaded guilty in Beaudesert Magistrates Court on 4 December 2018 before Magistrate Tracey Mossop in relation to one charge of failing to feed their dog, Jersey. They had a long history with an RSPCA inspector trying to get them to just feed their dog. The Magistrate questioned why the 2 year prohibition order was being sought instead of one. Our barrister, Nathan Boyd, said there was a history which was aggravating, commencing back in No...vember 2014. The RSPCA had attended in relation to Jersey in November 2014, August 2015, March 2017 and June 2018. Each time the condition of Jersey improved with RSPCA guidance / referrals to a qualified vet. In August 2018, Jersey was taken to a vet clinic by a member of the public and was in very poor condition. Jersey was transported to the RSPCA Wacol Animal Care Campus and was seized by the RSPCA. Jersey began gaining weight (900g) within four days of being placed on a feeding plan. The Magistrate agreed with the aggravating history but said she would ameliorate some of the penalty to account for a tougher prohibition order. The defendants were convicted, with conviction not recorded, as well as ordered to pay $1,500 each with 50% moiety to RSPCA, and each ordered to pay $99.55 summons, $745.39 vet costs, and $550 legal costs. A two year prohibition order was made for all animals other than as approved by the RSPCA. All payments were referred to SPER. The Magistrate took into account the defendants’ remorse, early plea and noted that they weren’t willful or deliberate but incompetent. The Magistrate stressed that the photographs were horrible and said that the defendants had been given ample opportunity to comply. She accepted they have no money and have 2 children to support. The Magistrate said it’s a shame they didn’t care for the dog because the children will surely miss her they’d had her for 11 years.
