21.01.2022 In a recent decision, the Federal Circuit Court of Australia has found that what is on a person's Facebook page is information for the purposes of the Migration Legislation. The Department can use it to refuse a visa if, for example contradictory information is found. However, the Court said, the applicant must be given the opportunity to comment on this information before the visa application is refused. 17.01.2022 Substantial changes to the Migration Legislation have occurred on 19 November 2016. Are you affected by these? Ceasing employment while on a 457 visa - For 457 visas granted on or after 19 November 2016, you now have 60 days (instead of 90 days) to find a new employer. Bridging visas new expiry period - briging visas will now expire within 35 or 14 days of a certain event (instead of within 28 or 7 days of a certain event).... New definition of "member of the family unit" - did you know only partners and children usually under 23, can now be included in most visa applications? New temporary visa framework - do you know which visas subclasses have ceased, and which ones are now in force? Sponsors on partner visas will no be subject to character assessment on all applications - police checks must be provided when requested, and certain convictions must be disclosed to applicants.
