We have been following the Clarke Brothers’ case with extreme interest as some of you know, since we are producing a documentary and a movie based on this story. Our own research of the forensic evidence triggered the Appeal lawyers targeting the causation argument for the case. The Appeal was won but the findings have been suppressed to the media. We are not just talking about the agony experienced by thousands of individual victims and their families... think about the cost to society. If millions of dollars are spent to prosecute and defend thousands of people, this means BILLIONS of dollars are wasted whilst the true perpetrators are still at large. Not only crime is not stopped, but it’s multiplied. More suffering, more injustice. 06.01.2022 In one of the cases covered in our documentary, we have found evidence that the prosecutor had been given forensic evidence by the medical examiner that could have exonerated the accused, but, instead, chose not to disclose it to the defence prior to nor during the trial. 02.01.2022 Media reports have been fairly positive this time around despite the fact that gag orders prevent true reporting of what went on during the Appeal. However, our reading of the orders prevent publications of the judges decisions, NOT of the Appeal proceedings. If you are curious to find out why alleged "killers" were released from jail, you owe it to yourself to read these proceedings. Here's a spoiler: another PathWest state expert witness was eviscerated during the hearing...... yeah, misrepresentation of forensic evidence seems to continue to be live and kicking in WA courts. International studies have stated that 65% of miscarriage of justice cases are due to the wrongful interpretation of forensic science. Lawyers and judges are not Forensic Scientists. Unless proper expert witnesses are vetted and brought in to analyse, give their opinions and advice with due diligence from both sides of the court, the causes of our broken justice system will continue to hurt us all; more people will suffer whilst taxpayers foot the bills.
