24.01.2022 We've all heard the famous Benjamin Franklin saying: 'Nothing is certain, but death and taxes', yet so often we find people put off attending to life's most important paperwork - their Will. A Will, appointing a Power of Attorney and an Enduring Guardian are some of life's most important pieces of paperwork. Yet, why are they often overlooked? People often reveal that they've had getting a Will on their mental to-do list for months, sometimes even years. Some don't like to t...hink about their life-ending, some feel the choices of who to appoint is too challenging, and others are simply too busy to make it a priority. Can we urge you, chat with your partner or spouse about getting a Will. Perhaps it's time to review one that's been filed away in your safe since the '90s, or maybe it's time to put one in place. If you have assets, dependants, have been divorced, have a blended family - we urge you to connect with a lawyer to safeguard what you've worked for and the people that you love most. At Caldwell Martin Cox we have a range of options including: Face to Face appointments Zoom / Video Conferencing appointments Online Wills (for straight forward Wills) After Hours appointments. A Will isn't about doom and gloom and end of life, it's simply about taking care of your most precious people at a time when they will need it most. 24.01.2022 You've decided it's time to get a Will, but what are these things called 'Power of Attorney' and 'Enduring Guardian' - do you really need them? This is a common question among people getting a Will, and we want to break it down for you. A Power of Attorney (POA) is a written document appointing another person to act on your behalf in specified or all financial and legal matters. ... An Enduring Guardian (EG) is a person you appoint to make medical, health, or lifestyle decisions for you when you don't have the capacity to make these decisions yourself. If you've been thinking about getting a Will, but are confused by the legal 'mumbo jumbo', connect with the team at Caldwell Martin Cox. We've been servicing our community since 1950. 24.01.2022 When was the last time you reviewed your Superannuation beneficiaries? For the majority of us, we set the list years ago, with these beneficiaries often changing in our minds, but not on actual paper. Lance had this very discussion with a client recently, and it was quickly discovered that she had her first husband, her now-estranged sister along with one other family member listed. This left her new husband and children excluded entirely - and a future battle for their enti...tlements, most definitely on the horizon. We'd like to throw out a challenge to our community, to simply press pause on your busy life and check your policy or call your Superannuation provider. The time invested today can save headaches, heartache, and an unnecessary legal battle down the track. 24.01.2022 On this day - 28th Sept 2018 - Facebook reported a major security breach in which 50 million user accounts were accessed by unknown attackers. This resulted in around 90 million people being logged out to help fix the problem. Facebook said hackers exploited a bug that compromised its "View As" feature. This enabled attackers to steal 'access tokens', (remote log ins) which are digital keys that Facebook use to keep people logged in, across multiple devices, as well as when... they use Facebook to log into 3rd party sites. Mark Zuckerberg, Facebook CEO was called in to testify in a congressional hearing over Facebook's privacy policies, this sent a ripple effect of increased uncertainty among Facebook users around data security. This uncertainty sent further ripples impacting the company share price and return for shareholders. There are times when businesses need external help and guidance to assist navigate through challenging times. When it comes to business and commercial law, remember that 'Knowledge is Power'. Come to the team that's been servicing Macarthur and Wollondilly for 70 years. Ph: 02 4651 4800 [email protected] www.cmcox.com.au

Our team is dedicated to delivering excellence, every day for our clients, as they live to the CMC values. During this time, Leanne has provided exceptional service in a timely and professional manner. Leanne is a very intelligent, astute & hard working person who has an incredible ability to resolve issues. She is also empathetic, which is a quality which seems to be quite rare, but is invaluable. 19.01.2022 WORLD MENTAL HEALTH DAY 2020, is more important than ever due to the challenging time many have faced brought on by The Pandemic. Lock downs, need for self isolation, quarantine, mounting job losses, thriving successful businesses forced to close, suspension of school and sporting activities and the list goes on. While we recently had R U OK day, a day when we pause and ask a colleague, mate or family member "Are you OK?" the importance of this conversation to be at the ...forefront of our minds is needed now more than ever. Many businesses have been impacted by COVID19 within Macarthur, Wollondilly, around the state and country and of course the globe. The direct flow on effect for our community has been substantial, with many thriving businesses eating up their cash cushion. Putting business owners under unforeseen crushing pressure. We'd also like to pause and think about the people supporting the businesses, as business slowed or went into 'hibernation' the added strain filtered to employees and their families. With this, our community has seen a sharp increase in domestic violence, compounded by the Pandemic. Any form of physical or physiological abuse has the ability to chip away at peoples mental health significantly. Many are dismissing this form of domestic violence currently down playing it that his or her partner is simply under added stress and this too will pass. This is a red flag that needs to be addressed with urgency. Today on World Mental Health Day we'd like to call on our community to do 2 things. Firstly, put your own oxygen mask on before helping others. Check in with yourself and pause for some self care. This may be some time in the sun, having a massage, reading a book, writing a letter to yourself in a journal, connecting with a dear friend or even speaking to a neutral professional. Secondly, check in on your friends, neighbours and colleagues. Not just the ones that look a bit down, but the one bouncing along telling you everything has never been better. As a community we've shown resilience, tenacity and strength through bush fires, floods, Covid, and localised fires in Camden. If asking seems too direct, send someone an SMS, or drop them an good old fashioned hand written note to let them know you're thinking of them. Knowing someone cares always makes the world of difference. Caldwell Martin Cox - supporting Macarthur and Wollondilly for 70 years. www.cmcox.com.au

19.01.2022 On this day in 1868 - Golf's 1st hole-in-one was recorded by Tom Morris at Prestwick's 8th hole, Scotland. While many chase the greatly sought after hole-in-one, did you know that there's been a number achieved at Camden Golf Club - Studley Park. Locals such at Bob from Camden Tyre Service and Jacinta from JLM Conveyancing have both achieved a hole -in -one at Studley Park. ... Do you know someone that's achieved a hole -in -one? Perhaps you should invite them to the Charity Golf Day on the 12th October, hosted by Rotary Club of Camden, supporting two standout local charities: Shining Stars Foundation Street Outreach Service and The Right Start Foundation supporting families touched by Down Syndrome. 19.01.2022 ON THIS DAY - 2nd November 1992 the first test flight of Airbus A330 took place. It's hard to believe this was 28 years ago, and here we are today with most travel grounded to a halt. In the memory of long distance travel, we ask you to post a favorite holiday pic in the comments below, as we share a few fun facts about the Airbus A380... The A380 has a maximum takeoff weight of over 589, 000 Kilograms as much as seven Boeing 737-800s It can carry up to 23,000 litres of water, feeding the onboard showers, as well as the standard bathrooms and galleys. It's maximum fuel capacity is over 321,000 litres, or about the same as 5,300 Toyota Camry's Approximately 40% off all airbus A380's are owned by Emirates Emirates configures an incredible 615 seats on the A380 and are the undisputed world record holder for most people ever on a passenger airplane You can take a shower when flying first class on Emirates or Etihad, and a personal butler service in ultra-first class known as The Residence aboard Etihad A380s are flown with joysticks, that looks like a video game joystick. This is a trademark of every Airbus except A300 and A310 A380 has no successors to date, sometime in 2030's the last revenue flight of an A380 will touch down. There are currently no planes currently being designed matching it's size or capabilities Caldwell Martin Cox - supporting our community since 1950. 12.01.2022 Flashback Friday - let's wind back to 23rd SEPTEMBER 1965 when lawyer and judge Roma Mitchell became the first female judge in Australia. Roma Flinders Mitchell was born in Adelaide on 2 October 1913. She was educated at St Aloysius Convent College, Adelaide, and held ambitions from a young age to be a barrister. She excelled at Adelaide University, and her involvement in student politics led to her being a pioneer for women's rights when she was denied entrance to the Law... Students' Society because she was a woman. This event led to the formation of the Women Law Students' Society. Roma Mitchell was admitted to the Bar in 1934, and became a partner in the legal firm of Nelligan, Angas Parsons and Mitchell in 1935. She continued to excel in her career, an example of which was in 1940 when she was instrumental in assisting the drafting of the Guardianship of Infants Act, passed later that year by the South Australian Parliament. On 23 September 1965, Mitchell was made a Justice of the Supreme Court of South Australia, the first Australian woman to achieve this position. Pioneering the Australian women's rights movement, Mitchell was also the first woman in Australia to be a Queen’s Counsel (1962) and a chancellor of an Australian university, being Chancellor of the University of Adelaide from 1983-1990. As Governor of South Australia from 1991-1996, she also became the first woman Governor of an Australian state. In 1982 Roma Mitchell became a Dame Commander of the British Empire. 12.01.2022 When can I light a fire on my property? As we move into the warmer month's people often want to burn off excess green waste and material as they prepare their properties. However, what most people in the Camden and Wollondilly Local Government Areas don't realise is that it’s illegal to light a pile burn on your property without the necessary permits and approvals. At any time during the year residents are required to obtain an Approval from their Council to conduct a burn. ...In addition, if you plan to conduct the burn during the Bush Fire Danger Period which usually runs from 1 October to 31 March (or as varied for local conditions) you must also obtain a Permit from either the NSW Rural Fire Service or Fire and Rescue NSW Why are Approvals and Permits required? While many pile burns are conducted safely, the NSW Rural Fire Service are regularly called to escaped pile burns that have run into neighbouring properties and even destroyed fences and structures. As an example, one of the many large fires that occurred during the 2019/2020 fire season was caused by a person in northern NSW conducting a pile burn without an Approval or Permit and on a declared Total Fire Ban Day. Once lit, this fire was left unattended and then escaped, leading to the destruction of multiple homes. The reason the Approvals and Permits are required is to try and ensure that all pile burns are conducted safely and to a standard that can be managed by the person lighting them. The Approvals and Permits will be issued with conditions which cover matters such as the size of the fire allowed, location of the fire, supervision, notification to the necessary authorities prior to lighting, water supply, and what fuels cannot be burnt. If a Total Fire Ban is declared, then all Approvals and Permits are suspended. When are Approvals and Permits not required? Approvals are not required for fires that are lit for the purpose of heating or cooking, provided that the fire is in a permanently constructed fireplace, surrounded by clear ground, and is completely extinguished before leaving. Penalties Even though you may be conducting a pile burn, it is common for neighbours to see smoke or flame and call '000'. Generally, this means the Rural Fire Service will be sent to investigate and if you are unable to provide the necessary Approvals and Permits then you can expect a fine from your Local Council in the following weeks. If you regularly breach the law, then you may be prosecuted in the Local Court and the maximum penalties start from fines up to $5,500 and 12 months imprisonment. If a fire you have lit is responsible for the destruction or loss of property and assets, then you may be prosecuted and also sued by the victims to compensate for their losses. 10.01.2022 On this day: 16th November 2015, the Largest diamond discovered in more than a century, a 1,111 carat stone was found in the Karowe mine, Botswana. The diamond that was just smaller than a tennis ball, second in size only to the Cullinan diamond cut into the British Crown jewels, was unearthed by Lucara Diamond in Botswana. "The significance of the recovery of a gem-quality stone larger than 1,000 carats, the largest for more than a century and the continued recovery of high-...quality stones from the south lobe, cannot be overstated," said William Lamb, CEO of Lucara. With all of the 'on this day' facts we share there's usually a link to law. We could share about how having a great legal team on your side is more precious than diamonds. Over the coming weeks, we'll share a few suggestions to ease frustration, to assist both parents, and most importantly, the children to have a great Christmas. ' : .... By doing this, you will keep the 'magic of Christmas' alive as your child discovers 'Buddy the Elf' is watching them at both homes. While the elf is present, he's watching you also, so be mindful not to speak to the child about any issues or challenges you're experiencing in life or with the other parent. 05.01.2022 What you need to know about Granny Flats and Capital Gains Tax. Caldwell Martin Cox welcomes the announcement by the federal government that they intend to introduce legislation to remove Capital Gains Tax on the creation, variation or termination of formal written Granny Flat Agreements that provide accommodation for older Australians or people with disabilities. We have clients contacting us almost weekly to try to sort out disputes arising that involve granny flats. Oft...en the 'granny flats' are sizeable dwellings in their own right and have been a substantial investment by their owners. Our very strong advice to anyone contemplating building a granny flat on their property to house family is to have an agreement formalised in writing about it. Who will pay the utilities on the dwelling? Will council rates be shared? What happens if the owners decide to sell the land? What if there is a marriage breakup or a death in the family? All of these issues and more can be solved with a simple agreement between the parties. And, as from 1 July 2021, the Agreement may not be subject to CGT. 04.01.2022 So, your business vehicle is detected committing an offence by a camera, who pays the fine? A lot of business owners have vehicles registered in the business name which they use for the many kilometres they travel each year. However, more kilometres also mean a greater chance of committing an offence on the road. If your business vehicle is detected committing an offence by a camera then the business is required to nominate the driver of the vehicle at the time. This is beca...use only a person can commit a driving offence, not a business, and Roads & Maritime Services will want to assign the applicable demerit points to the driver. For those drivers who may be close to losing their licence this often raises the question.."what if the business chooses not to nominate a driver?" If a business does not nominate a driver then the business is required to pay a fine for the offence which is significantly higher than it would be if a person was nominated. The business will also receive a further fine by way of a Penalty Notice for failing to nominate a driver. If this occurs on multiple occasions Roads & Maritime Services will often prosecute the business in the Local Court where fines up to $11,000.00 plus Court costs and fees can be imposed. If your business can have many different employees driving various work vehicles we strongly recommend that a log book be maintained. This log book should record who is driving which vehicle and at what time each day so that the business does not find itself answering to a Magistrate. 02.01.2022 On this day - 9th November 1938, L.A. Kindergarten teacher Helen Hulick went to jail for wearing pants in a courtroom. Hulick, 28, wore slacks during a court appearance to testify against two men, and her testimony was rescheduled and Hulick was ordered by Judge Arthur S. Guerin to return to the court in a dress. Hulick was quoted in the, Los Angeles Times saying, You tell the judge I will stand on my rights. If he orders me to change into a dress I won’t do it. I like sla...cks. They’re comfortable. 01.01.2022 The 2020-21 Budget measures include an additional $87.3 million for family law services that help families going through a separation to resolve matters without having to go to court. As part of Australia’s Economic Recovery Plan, the Morrison Government is providing additional support for Australia’s legal system to help those affected by the COVID-19 pandemic and to support those using the courts to resolve their matters as quickly and efficiently as possible. Attorney G...eneral, Christian Porter, says Legal fees associated with protracted court action can rapidly eat away at the funds parents need to restart their lives after a separation, so it makes good sense to assist them to settle matters amicably wherever possible.
