23.01.2022 5 benefits of Same Sex Marriage [from an Estate Planning point of view] Recently one of our Directors, Kasey Fox, wrote a blog about some of the benefits of same sex marriage from a family law perspective. Now that the High Court has given the green light for the postal vote, I have set out below 5 additional benefits of same sex marriage from an estate planning perspective.

23.01.2022 I spoke to the ABC yesterday about an issue arising from the legalisation of same-sex marriage. The question is, essentially, whether same-sex marriages between... Australians that took place overseas prior to 9 December 2017 were legally solemnised on 9 December 2017 or on the date of the overseas marriage. In the former case, Wills made between the date of the overseas marriage and 9 December 2017 may be revoked. In the latter case only Wills made before the date of the overseas marriage would be affected. It is a slightly technical issue but it may have considerable consequences for same-sex couples. Josh Robertson's article discusses the issue very well.

20.01.2022 This is an appeal to a decision to award the daughter of a deceased billionaire $25 million instead of the $3 million she was left in the Will. We are watching this space closely - you can bet that this will be a decision that will see a lot of discussion and will surely have an impact on clients.

16.01.2022 There is little that compounds the intense grief of losing a loved one than surprises and uncertainty about the terms of their Will. This can make litigation more likely. We encourage clear, honest communication - either in person or in writing - to avoid these kinds of surprises. Our hope is that it prevents unnecessary litigation. Unfortunately, sometimes litigation is inevitable. In these cases, lawyers should help to resolve the real issues efficiently and practically so that the family can grieve the loss of their loved one.

02.01.2022 Dealing with Gender Dysphoria and being Gillick Competent There is a protocol that sets out the division of work between the Federal Circuit Court and Family Court, both of which have jurisdiction to hear and regularly do hear matters under the Family Law Act. One of the types of cases that are determined by the Family Court is ‘special medical procedures’ such as gender reassignment and sterilisation.
