16.01.2022 CASUAL EMPLOYEE OR FULL TIME WORKER - IS THERE A DIFFERENCE? Close If you have employed a casual employee on a regular and ongoing basis for more than 12 months, not only may you be up for an unfair dismissal claim if the circumstances allow, you may also need to offer them full time employment or risk heavy fines and paying up on full time entitlements.... Some industry Awards already set out the need for an employer, in certain situations, to effectively offer their casual employee fulltime employment. Many believe that the review being conducted into Awards by Australias Fair Work Commission will result in this change being included in all awards. It is this proposed change and others, that has the fruit picking industry up in arms with proposed changes to the pickers pay and conditions under the Horticulture Award.
