01.01.2022 Our vehicle is on this list, is yours? Nissan Pathfinder ABS brake system fault - if this occurs, an ABS warning lamp will illuminate to warn the driver. If the vehicle continues to be operated in this condition, the brake fluid leak may create an electrical short in the actuator circuit, which could lead to a fire. Replacement parts will not be available until Mid-2020 - Until the recall is commenced, consumers of affected vehicles are advised that if they see the ABS warning light continuously illuminated (10 seconds or longer), they should park their vehicle outside and contact Nissan Roadside Assistance for assistance.

01.01.2022 HAS THE COVID-19 PANDEMIC AFFECTED YOUR TRAVEL PLANS? Here are some general considerations regarding cancelations and your rights: Depending on your circumstances you may have rights under the Australian Consumer Law, and/or Contract Law.... Generally, the Australian Consumer Law is not designed to deal with circumstances where a contract cannot be completed due to an unforeseen event like the current Covid-19 pandemic, and so your rights would usually be limited to terminating the service for a failure to comply with one or more of the consumer guarantees. However, contract law has remedies specifically for circumstances like the COVID-19 pandemic. When an unexpected event stops a contract from being completed due to situations out of the control of either party, this is called force majeure. Commercial Terms and Conditions of trade should always contain a force majeure clause which will explain what is to happen is these circumstances. If there is no force majeure clause in the suppliers terms and conditions, then the contract may be said to be frustrated and the contract is then terminated for that reason. When a contract is terminated due to frustration, you will have the right to recover your money paid under the following contractual remedies: 1. failure of consideration this occurs where a party does not receive the performance of the agreed return for which the money was paid to the other party. 2. restitution the return of money to reverse and unjust enrichment. 3. unjust enrichment a benefit obtained by one party at the expense of another in circumstances the law deems is unjust.
