25.01.2022 2020 has been a huge year for Concept Planning and Development Consultants. This is only year 3 of this fledgeling consultancy and I am proud to say that, not only did we survive Covid and come out the other end of lock down relatively unscathed, we picked up new & repeat clients, delivered several development approvals for large and small applications, assessed countless applications for two different regional councils and engaged a virtual assistant to help out with admin tasks. Thank you to all our clients, consultants and colleagues for your support during 2020. We are taking a well deserved rest for the next few days and the office will be closed from 23rd December and reopening on 4 January, ready to face the challenges and opportunities that 2021 has in store for us. Merry Christmas have a safe and happy new year everyone!

17.01.2022 Since we are now in the post-Covid19 world I thought I would re-share this post I wrote a couple of years ago. It is worth thinking through the challenges and pitfalls of working from home. Covid has shown us all how many workplace scenarios can work well with staff off-site or working from home. Some businesses can also operate from home but planning laws have not quite caught up with this new trend. The impacts of your home based business may need to be explored, mitigated or a planning approval sought.
13.01.2022 Changes to the Planning Act 2016 have been put into effect by recent urgent amendments that respond to the need for flexibility during a declared applicable event. The Minister for Planning declared on 19 March 2020, that the Covid-19 emergency is an applicable event under s.275E of the Planning Act 2016, effective from 20 March 2020 until 20 June 2020 inclusive. The effect of this declaration allows the implementation of new provisions in the Planning Act 2016 to remove c...onstraints that may limit the operation and delivery of essential services, and makes provision for statutory timeframes for development assessment under the Planning Act 2016 and the Economic Development Act 2012 to be managed to allow local and state government decision making to continue to meet statutory timeframes where staffing may be unduly affected or limited as a result of the declared applicable event. These provisions are a permanent inclusion in the Planning Act 2016 moving forward and will cover declared applicable events moving forward such as bushfires, cyclones or other adverse disasters. For customers, this means that where conditions of approval have limited delivery or operational timeframes to mitigate amenity impacts of a development, and where the development provides an essential service that is covered by a blanket declaration of particular uses issued by the Minister, such development may operate, unrestricted, 24 hours a day 7 days a week for the duration of the applicable event. This also means that where customers have an application currently being assessed by local or state government the Minister has the ability to extend or suspend statutory timeframes. These extension notices will enable local and state government agencies to manage their workload during the period of the applicable event.
