Powers of Attorney function while you are still alive. They enable another person, appointed by you, to make decisions in relation to your finances. This can be because you are medically unable to, because you're going away on holiday and want someone else to be able to pay your bills, or for any other reason.

23.01.2022 When you're buying a house, most people will be telling you to get pest and building reports. Why? Because properties exist for generations, and there are bound to be little cracks in walls and chips in the paint. A lot of people won't know what are minor issues and what are major issues. For this reason, the seller isn't required to tell you the nitty gritty details about the condition of the property, some of which they may not be aware. So, we tell purchasers to have qualified people carry out pest and building inspections and provide a comprehensive report. This way, you can enter into the contract with your eyes wide open, knowing the condition of the property you're purchasing.

The deposit holder (usually the real estate agent) holds the deposit on your behalf until you exchange contracts, after which they hold it on behalf of both parties. We can't exchange contracts until you have paid your deposit, so there is no issue with getting this done early on!

Generally, the house should be in the same condition it was in at the date of exchange; however, it is always nice to give the place a good clean after you move out (think of it like a rental clean) to avoid any argument. 16.01.2022 We often talk about cooling off periods in relation to conveyancing, but what does it mean? The standard clauses of a contract for the sale and purchase of land in NSW provide purchasers with a cooling off period, being 5 business days after exchange within which the purchaser can rescind the contract for any reason. If they choose to exercise their right to cool off, the purchaser forfeits 0.25% of the purchase price to the vendor. Cooling off periods differ between states, and there are exceptions - stay tuned to learn more!

08.01.2022 This is a really common situation, and we promise - it's not the end of the world! Final Certificates provide that council attended the property and don't have any concerns regarding its construction. However, they are still a relatively new concept so a lot of homes don't have them. If you are concerned, you can apply for a Building Information Certificate which states that council will not issue any notices in relation to the property for 7 years, and after that time they will only issue notices regarding matters of wear and tear - not the entire structures that existed at the date of the certificate. Problem solved.
