24.01.2022 QLD Nomination Criteria Important changes announced for the s48 barred applicants. BSMQ has made following announcement for the Bridging Visa holders: s48 bar unable to lodge due to entry ban If an applicant is currently on a bridging visa and has been invited to lodge documents with BSMQ for a subclass 491 visa, they must notify Business and Skilled Migration Queensland of any past visa refusals or cancellations.... If an applicant has received a visa refusal or cancellation whilst on a bridging visa, they are likely to be subject to a section 48 bar which means they are unable to lodge a state nominated visa (and most other visas) onshore. Unfortunately, during the COVID-19 pandemic, it not possible to go offshore to lodge a visa application, and then return to Australia. This is because there is an entry ban on temporary visa holders returning to Australia at this time. If you or your client is section 48 barred, BSMQ is unable to nominate for a subclass s491 visa and request that the application be withdrawn. A new electronic application form will be introduced for the Skilled - Recognised Graduate visa and Temporary Graduate visa on 14 November 2020. If you start a visa application you must submit it by 13 November 2020. If you do not submit your application, it will be set to a status of 'discontinued' in ImmiAccount. You will not be able to open it again. You must start a new application to apply for your visa.

However, no nominations will be issued until the Northern Territory has been allocated quotas. Offshore GSM will still be closed until further information is announced. Subclass 190 is ongoing, but occupations on the ACT Critical list are prioritised. New invitation round is expected on or before 23 October 2020. 08.01.2022 PTE score change but NOT EFFECTIVE YET PTE Concordance Report Pearson PTE has recently released a report that has reassessed the concordance between PTE English language scores and those of the IELTS scores.... PTE has adjusted some scores to better align with the IELTS standard scores. These changes have been reported to the Government's of Australia, New Zealand and the United Kingdom, all of who accept PTE English language tests for migration purposes. However, until a new legislative instrument is released changing the scores, the currently legislated scores will remain in force. Nevertheless, it often takes a considerable amount of time for new legislation to be drafted and released.

06.01.2022 MIA Notice 64 - 2 September 2020Legislative Instrument - Jobactive Labour Market Testing Legislative Instrument - F2020L01123 - LIN 20/156: Jobactive - Period, manner and evidence of labour market testing Amendment Instrument 2020. This Instrument amends LIN 18/036 to include an additional requirement for the manner in which labour market testing is undertaken.... LIN 20/156 requires ALL nominated positions to be advertised on the Government’s Jobactive website. The Government’s Jobactive website is a free online jobs website that is accessible via the internet. Businesses considering nominating overseas skilled workers on Subclass 457 Temporary Work, Subclass 482 Temporary Skill Shortage or Subclass 494 Skilled Employer Sponsored Regional (Provisional) visas, will be required to advertise these vacancies on the Jobactive website. This measure ensures that appropriately skilled Australian citizens and permanent residents are given work opportunities before overseas workers when a business nominates a vacancy. The new requirements for advertising may be summarised as follows: must be advertised on the Jobactive website, ANDmust be advertised with at least two advertisements in one or more of the mediums, already specified in LIN 18/036,Item 8(3).applies to ALL nominated occupations, not just those in the newly announced Priority Migration Skilled Occupation List (PMSOL)applies to nominations made on or after 30 September 2020. The new amending provision in LIN 20/156 applies to nominations made after 28 days from the commencement of the instrument. For clarification, the 28 day period begins on the day LIN 20/156 commences. The instrument LIN 18/036 as in force immediately before the commencement of LIN 20/156, continues to apply to nominations made on or before the commencement of the 28 day period.
