02.01.2022 Over the past month, I have attend various events, listened to many webinars and read countless articles on the upcoming Australian Privacy Law Changes and reporting obligations under the NDB amendments that come into effect this week. Mostly, I have found, the message to be inconsistent and confusing, especially for small business operators. This also relates to insurers/brokers who tout to be cyber experts when offering a cyber insurance policy to cover some of the areas o...f potential risk. Most rely on a best guess approach, without actually looking closely at the cyber value at risk to a business (business interruption, outsource contracts, supply chain etc.). Designing a specific cyber insurance program is extremely important as risk may cross-over numerous policies, including PI, D&O, Business, Property etc. A simple claim example, the loss of a mobile device that contained unencrypted, confidential data. Which policy would respond? Cyber insurance is very complex and when purchasing a cyber product, engage with experts that not only have an insurance background, but more importantly understand the ever changing cyber security threat landscape. Lastly, buying the wrong cyber policy can potentially be catastrophic, don't make that mistake.
