22.01.2022 A S H B Y A recent Character House renovation Doyen gained approval for, giving this old girl a new lease on life with a lot of extra living space and some modernisations to keep her looking young and well preserved. This project overcame negotiation elements of proposed demolition and extension works, along with the difficulties of access to the site, burdened by a massive street tree which Council was opposed to removing.... This project was helped along (quite significantly) by having an owner that was reasonably knowledgeable and active in preparing alternate options for consideration. 13.01.2022 B A I L E Y Site Update A few short weeks ago this site was predominately dirt with freshly poured foundations. The guys at @lindon_homes haven’t wasted any time in getting the slab down and frame up an impressive feat given the size of this place.... One of the unique features of this house is the Hebel PowerFloor finish to the upper level I’ve heard mixed feedback on the product but this is my first exposure to it and I can say first hand that I found it solid under foot and was impressed by how well of a job it did at noise dampening as we stomped around the upper level testing it out. Being up on the second floor overlooking the water and seeing the remarkable view first hand for the first time was fantastic incredibly glad to have been able to achieve the planning outcomes being brought to life with this build, the finished product will be spectacular keep your eyes peeled for future updates . . . 06.01.2022 C H A N G E Change is as good as a holiday, so they say It’s not uncommon for market conditions or site conditions to change from paper concept to detailed design/construction stage. Sometimes these are months and even years apart, so it’s not completely unexpected.... This was the case for the above pictured townhouse project - a client we have completed a couple of projects for came to us mid construction needing their approval changed as they had reduced the number of construction stages and adjusted some basic elements during construction as the paper approval wasn’t as practical as first anticipated. We got this through swiftly for the client with minimal delays Where changes occur during construction, it’s important that you ensure your DA reflects what’s occurring - Council are cracking down on ‘as constructed’ changes and we have seen construction / sale delayed by months due to these issues. Come to us early and changes can be resolved early - come to us once Council or a Certifier are unable to sign off on the changes and they take significantly longer, costing you a lot more $$$ then you ever needed to spend. 04.01.2022 P R O J E C T - C O N S E R V A T I O N We recently had a client referred to us who owns a parcel of land on one of the Southern Moreton Bay Islands (SMBI’s).... The site is zoned Conservation - City Plan states that a Dwelling House is not envisaged within this zone. Imagine owning a block of land with direct water frontage, but you can’t build anything on it!? Our gut instinct was that this didn’t seem right Either side of this block of land are lots with Dwelling Houses there is ample cleared land for a dwelling to be constructed, surely Council can’t be this harsh!? We recommended that the property owners undertake a formal pre lodgement meeting to obtain feedback from Council. The feedback received today during this meeting was relatively positive there will be a few hurdles to overcome, and a whole lot of paperwork, but I’m optimistic that there’s a Dwelling House approval coming their way in the not too distant future We’ll keep you updated
03.01.2022 WHO DID IT BETTER? Swipe Swipe The Great Wall (2016) IMDB 5.9/10, or The Great Indooroopilly Wall (2020) IMDB 11/10?... A few months back a regular client reached out for advice ‘A wall has been constructed for retaining at a site in Indooroopilly, there is a section ~2m in height that needs approval, it’s already built, the neighbours have complained, Council has issued a notice, what do we do?!’ Not normally a job we would take on being a Town Planning Consultancy (retaining walls are largely Engineering), but a regular client needed a hand, so we agreed to give it a shot. To help you visualise the situation, there was over 100m of retaining wall that had been constructed , the owner was NOT happy and neither was the Certifier, the Pool builder nor the Landscaper it was at the ‘just fix it’ stage. We gathered Engineering documentation (oddly way more difficult than it should’ve been), lodged the application, negotiated, clarified, shone light on an outcome that didn’t involve Councils immediate request to ‘change the wall’, gave hope to an owner who was facing the financial prospect of pulling a wall down and rebuilding during a time where his job was significantly affected by COVID. The end result a satisfied homeowner, a wall that remained unchanged , and a neighbour who was happy with the final product . We won more combats then Matt Daemon if you ask me. . . . 01.01.2022 How long does my Development Approval last? If you’ve purchased a site ‘DA Approved’ or recently obtained your own approval, you may be wondering how long the approval has left or will last. At the time of posting, the Planning Act 2016 outlines default currency periods.... Here’s a quick rundown of the most common types Material Change of Use (MCU): 6 years for the use to happen (i.e. use commences). Reconfiguration of a Lot (ROL / Subdivision): 4 years for the plan of subdivision to be submitted to Council for plan sealing. Building Work: 2 years, and the work must substantially start within that period Staged Approval: Any aspects completed within the currency period are lawful, any stages not complete lapse. Reaching the end of your currency period isn’t the end of the world Planning Act allows the extension of these periods however these are discretionary and not guaranteed, so it’s best to request an extension earlier rather than later. Extensions must occur prior to the lapse date. If you’re buying a site with ‘DA in place’ give us a call before you sign any paperwork and we will look over the approval and outline important information such as the currency period. If you’ve recently obtained an approval and your consultant hasn’t provided you with a detailed rundown of your obligations and timeframes, this is something we can assist with too.
