25.01.2022 We all know that our lives and circumstances can change. It is common for our firm to be asked about changing Final Court Orders when there has been a change in our client’s lives or circumstances. Unfortunately, however, it is not always a straight forward exercise.



25.01.2022 ** Family Court of Australia and Federal Circuit Court of Australia launch COVID-19 List to deal with urgent parenting disputes ** The Family Court and the Federal Circuit Court have launched a special COVID-19 list to deal with urgent parenting matters; such as domestic violence, supervised contact and existing orders impacted by COVID-19 restrictions. The list started yesterday, 29 April 2020 and will run for an initial period of three months. It will be interesting to see how this plays out in practice!

14.01.2022 The requirement for social distancing has created issues for signing and witnessing Court documents. The Family Court has released a new practice direction that allows for documents to be signed electronically.

11.01.2022 The health and safety of our staff and clients is our highest priority. In light of the heightened level of concern related to Coronavirus (COVID-19) we want to update you on what we are doing so that we can ensure the safety of our clients, our staff and their families during this uncertain time. We are making some changes to how we operate effective immediately to do our part in managing the current risks: Our staff will be working from home. We have implemented measures ...to ensure our staff can efficiently and effectively work remotely. We will not be conducting face-to-face meetings at this time. For the time being, all consultations will be conducted via telephone, Skype or FaceTime. If your matter is listed in Court, you will be contacted by our staff in respect of this. At this time, we have seen the Court adjourning all non-urgent property matters. Where possible, we will be applying to appear by telephone for Court appearances. 09.01.2022 The Hon William Alstergren has released a statement on behalf of the Family Court of Australia. Parents are naturally deeply concerned about the safety of their children and how the COVID-19 virus will affect their lives. Part of that concern in family law proceedings can extend to a parent’s or carer’s ability to comply with parenting orders and what should be properly expected of them by the Courts in these unprecedented times. The purpose of this statement is to clarify that the Courts remain open to assist parties, and to provide parents with some general guidance. However, it is understood that every family’s circumstances are different.



07.01.2022 The Family Court of Australia and the Federal Circuit Court, which both hear family law matters, have urged parents to act in the best interests of their children and respect the "spirit" of co-parenting orders where "strict compliance" is difficult or impossible due to the COVID-19 pandemic. However there are some cases where existing access arrangements must be altered.
