I recommend doing the challenge next year if you didnt participate for 2019! Here is a link to the article in Lawyers Weekly... It is most important we care for ourselves so that we can care for our clients. https://www.lawyersweekly.com.au//24836-the-benefits-of-ha

24.01.2022 Today myself and an expert member of the criminal bar obtained a fantastic result for my client. As usual in these types of proceedings much information gathering is required and standing by our clients side insured the best possible outcome achieved. The additional factors of requiring interpreters to assist with communication with my client throughout my dealings with them and ensuring that pursuant to practice direction 1 of 2010 the appropriate application for an order of the court to accommodate my client with ensuring he they were provided with the tools by way of a court appointed interpreter to ensure understanding of the proceedings and processes were paramount to ensure fair and equitable justice.

22.01.2022 Keep an eye out for a link for an article I put together for the Russo Lawyers website regarding New South Wales disqualification application for those who may have been a habitual traffic offender under the old HTO scheme.

20.01.2022 Been a great first day back at MBRCLS supporting our most disadvantaged in the community. What a full house 40 clients glad to give back to the community nothing makes me happier than providing justice to those most in need those that cant obtain funds for legal services. The importance of community legal funding is imperative to access to justice!

20.01.2022 So much is said about the role of a Criminal Defence Lawyer, these comments by the President of the Tasmanian Law Society are so eloquently put. Read the article in full here: https://www.lawyersweekly.com.au//24316-tassie-law-society The maintenance of the rule of law requires a strong and independent legal profession. That profession stands up to government overreach and represents the vulnerable, including those charged with criminal offences.... It is often not a popular thing to do, but fairness demands that everyone, including those charged with a crime, be given a fair go. Unfortunately, your comments demonstrate that you have little idea or regard for such important principles. - President of the Tasmanian Law Society.

19.01.2022 From time to time watch this space for a segment I coined Fraser Notes this post may be a simple piece of something or a review or update in an area of law that is general however should never replace formal legal advice. If in need of assistance with legal matters a solicitor should be contacted as soon as practicable.

18.01.2022 Lawyers should not be shy to raise issues and call out police misconduct. All to oft we see an abuse of powers under the Police Powers and Responsibilities Act. We in our roles need to ensure that we call out misconduct when it is observed. The community should draw an inference that the police service will look after the community and address all complaints adequately and with due diligence and investigate appropriately without making assertions or basing opinions on incom...plete investigations. An integral part of reviewing decisions should be made by independent bodies not by more senior officers an appropriate external measure should be made to ensure the appropriate checks and balances occur. If you or any one you know need assistance contact myself or one of our friendly expert staff at Russo Lawyers. Were on your side! https://www.lawyersweekly.com.au//24199-lawyers-should-not

18.01.2022 Today an expert senior member of the criminal bar and I obtained the best possible outcome for a client in the District Court at Brisbane. Legal matters can be a stressful time for those involved and their families.

17.01.2022 practising law is a true reflection of ourselves. Having a strong cultural background with diverse upbringing and understanding cultural values I am best positioned to assist my clients with their legal problems. Coupled with my personal values, ethos and character I aim to support my clients through their legal issues ensuring I do everything in my powers to obtain the best possible outcome for my clients. ... I am grateful for my diversity as it also harnesses my community values and ethos with respect to my community involvement and community enshrined values. I continue daily to support headspace Caboolture and KYC Youth in achieving their objectives within my local community as well as actively advocating in areas of interest within my community.

17.01.2022 Some very wise words from Queensland Law Society President Bill Potts - One of the fundamental tenets of being a solicitor is that you do what is right, even if what is right is not popular. After all, anyone can do the right thing if it brings the applause of the crowd; when the right thing brings the slings and arrows of outrageous fortune-or indeed, unfortunate outrage-people are often content to do the wrong thing, or at least not to act at all.

10.01.2022 Wishing everyone a prosperous 2019. As we start the year and we start getting busy a small quote I am reminded of. Being able to do some form of service is a gift. The one that provides the service is the greatest beneficiary - Kenneth Cole

09.01.2022 News just in ... good law can only be made in consultation with the appropriate and relevant stakeholders to prevent issues and unintended consequences. The Queensland law society has written to the Attorney General in relation to the lack of consultation given the amendments were drafted a number of weeks ago. ... See attached letter to the AG and article from the QLS. http://www.qls.com.au//3668_-_Lack_of_consultation_in_rece Lack of consultation in recent reforms Overnight, the Queensland Government introduced and passed amendments related to post-sentence monitoring of convicted sex offenders. There was no parliamentary Committee review or consultation with QLS on the proposed drafting. The amendments were added to an existing Bill late yesterday afternoon and were passed last night. QLS advocates for good law for public good. As a trusted and long-serving stakeholder in Queensland legislative consultation processes, we are in the unique position of being able to identify whether proposed amendments will best achieve their intent and avoid unintended consequences. If the ordinary protocols were followed, these matters would have been scrutinised through the public Parliamentary Committee review process.

09.01.2022 It is both comforting and rewarding to be acknowledged and thanked for the many hours of work invested in my clients every day. A fantastic outcome for this client and very happy and relieved family knowing the process is complete and a great result.

All those who practise in the law know the work to be undertaken prior and post admission. One is blessed to have had the love and support of this great woman and mother of our two (2) beautiful girls throughout all the endeavors pre and post admission. ... Happy Anniversary Marissa.

07.01.2022 Focus on client care is imperative to the practice of law. Today I attended Burpengary mens shed invited by President Rodney Hanson to talk to the men of the importance of wills and estate planning. In the afternoon I again went out to Borallon Correction Center and met a new client who advised that the previous legal representative had made no contact with the client since April. I assured the client that care and communication and video link conferences as well as if required prison visits all form part of the client care I provide for my clients. #clientcare #allinadayswork

07.01.2022 Half way through the week its been insightful and as I turn my mind to client care it is one of the main functions of the many daily tasks of any lawyer and of course should be in the front of ones mind when advising in any matters to ensure your on their side.

06.01.2022 Was very humbling receiving this award from @SI Moreton North Inc I am proud to support the work that SIMNI do in our community and globally for @soroptimist International and am proud to advocate with them for gender equality and the theme of when we invest in women we invest in the future is a fantastic one indeed. All members of this organization should be proud of the work that they do being a strong voice for women globally! To our girls and women of tomorrow may we raise them, may we inspire them and may we support them!

06.01.2022 Today in the Magistrates Court Brisbane I obtained the best possible outcome for my client. This was a matter that I made a Section 172 application under the Mental Health Act 2000 (http://classic.austlii.edu.au//consol/mha2016128/s172.html )for dismissal of criminal charges at the discretion of the Magistrate on the balance of probabilities that at the time of the offences the person appears to be of unsound mind at the time of the offending. This was a young person and t...hey had my support and the support of their family and subsequently I am of the view this person will do well in life as this was all in the material before me and in my submissions to the court. The conclusion of the matters had the clients support in tears and full of gratitude. Involved was culture, youthfulness and strong strides of development and growth.

04.01.2022 A positive outcome for our client today at Brisbane Magistrates Court. If you or anyone you know need legal advice please do not hesitate to contact me or our friendly expert staff at Russo Lawyers Were By Your Side.

02.01.2022 Fraser Notes A fundamental right is the right to remain silent. In the event you are apprehended by police they may ask you some questions or ask you to participate in an electronic record of interview. ... You have the right to advise police you do not wish to answer any questions until you seek legal advice. At times they may advise you that they need to electronically record this statement however this is not the case. Remember that anything you say to the police could be used against you as evidence at a later point in time so it is always best to seek legal advice before answering any questions. The mere fact that you choose not to answer questions and seek legal advice cannot be used against you at a later point in time or to draw an inference of guilt however some instances may draw negative inference so it is important to obtain legal advice as soon as practicable. If you are not in a position to obtain a solicitor you should exercise your right to silence until you are able to do so.

01.01.2022 This morning Im at Southern Queensland Correctional Centre. As I have said before client care is most important in all stages of the client lawyer relationship. Delivering the result from the Court of Appeal decision to a client and checking in with another as our involvement in those matters get close to wrapping up. ... Checking in and ensuring good client care assists with what is a difficult, lengthy and stressful process. During difficult situations its good to know someone is listening and cares, someone who has your best interest at heart can assist with the complexities and understanding the process and how to cope throughout these times.
