An employee's Ordinary Time Earnings (OTE) based should be used for superannuation calculations

15.01.2022 Understanding the National Employment Standards (NES) The NES provides minimum entitlements for all employees in the national workplace relations system (regardless of the award, registered agreement or employment contract that applies). An employer can provide more generous entitlements, but they can't be less than the NES. Casual staff only have entitlements under some of the NES, and this can depend on length of service and regularity of work.... The NES covers: - Maximum weekly hours - Requests for flexible working arrangements - Parental leave and related entitlements - Annual leave - Personal/carer's leave, compassionate leave and unpaid family and domestic violence leave - Community service leave - Long service leave - Public holidays - Notice of termination and redundancy pay - Fair Work Information Statement Follow us as we look at each entitlement and what it means for employers and employees.

Some awards do have a provision for payment at the start of the leave, but this is designed for employees paid by cash or cheque, not EFT. 09.01.2022 The Australia Day public holiday is recognised as Monday 27th January this year. Only South Australia recognises both Sunday 26th and Monday 27th as public holidays. Unless your award or agreement states otherwise, working on Sunday 26th January will only attract regular Sunday rates, not public holiday rates (SA excluded). 09.01.2022 A Perth cafe has been taken to Federal Court by Fair Work for discriminating against a pregnant worker, by cancelling and reducing her shifts. Total penalties of $44,800 were imposed, including compensation to the worker. It is unlawful for employers to discriminate against employees on the grounds of pregnancy, race, colour, sex, sexual orientation, age, physical or mental disability, marital status, family or carer’s responsibilities, religion, political opinion, nationality or social origin.
