A conveyancer is a person who is authorised to carry out conveyancing transactions that is transactions relating to the purchase or sale of a property. They are authorised to carry out all transactions to effect the purchase or sale but are not qualified to give legal advice. ... Only a solicitor is qualified to give you legal advice. There are many situations where in the course of the conveyancing transaction there could be problems that arise in relation to the contract or restrictions relating to the property or disputes. Only a solicitor is qualified to give you legal advice and if necessary take court proceedings to enforce your legal rights. A Conveyancer is not authorised to take any court proceedings on your behalf. Many people choose a conveyancer because they believe that they are somehow cheaper. 20.01.2022 BUYING A BUSINESS OR SIGNING A COMMERCIAL LEASE? It is very important that before you buy a business or sign a commercial lease that you consult a lawyer. But I can do it myself... The conditions on contracts for sale of business are very complicated and it is important that you understand your responsibilities and obligations. Some things to consider: Are the takings of the business correct, and how can you verify this? What licences, right, social medical accesses etc need to be transferred? Are there adequate restrictions on the seller to prevent them from setting up a business in competition with you? Are there any factors that may have an effect on future customers of the business for example road widening projects or redevelopment proposals? Are the good of the business included in the contract, and are they in good working order? Has there been full compliance by the vendor with the licences, including liquor licence, health permits, trading permits etc? BUSINESS LEASES Having the right lease for a commercial space can affect the value of the business. Some things to consider: What is the right term of the lease? What are the options to extend? How are increases in rent covered in the lease? Are they exceedingly high? Is there any demolition or relocation clause in the contract which would enable the landlord to require you to move out? We have had examples of clients who before seeking advice signed a 10 year lease. Their business then failed, and they were obligated to compensate the landlord for the full 10 years, or until another tenant could be found. This financial burden could have been avoided if they had started with a shorter initial lease with an option to extend. 19.01.2022 FAMILY SEPERATION AND FINANCIAL AGREEMENTS "I can do this myself" Some people, who are still communicating with their ex-partner wish to come to an agreement about their financial affairs. The question then is "cant we just sign the form saying we agree, and then transfer the property and settle the matter ourselves?"... Generally NO. ANy financial agreement for a de-facto or married couple who have separated is ONLY binding if it is approved by the Federal Circuit Court as an order of the court. This type of application requires full disclosure of your financial matters and must be fair to both parties. COMMON PROBLEMS We have become aware of situations where parties have between themselves signed an agreement about financial matters and have even had the agreement witnessed by a police officer, and then have proceeded to sell the property and distribute the funds. Then, after a few years, one of the parties has made an application to the Court and obtained a higher settlement regardless of the prior agreement. WHY SEEK LEGAL ADVICE? An application for approval of financial agreements is not straightforward. You can attempt to do this yourself, however, unless you are fully familiar with the legal process we STRONGLY recommend that you consult a lawyer so that correct and binding court orders are made.
