Preparing an Enduring Power of Attorney and Appointment of Medical Treatment Decision Maker are both very important steps to take in your estate planning. We often see these documents prepared by clients ...with mistakes, with such mistakes making the power void. If you don't have a power of attorney and you lose capacity, someone close to you (usually a spouse of adult child) will need to apply to VCAT to be appointed as your Administrator in order to sign documents on your behalf and make legal and medical decisions for you.
