24.01.2022 CLASSIC VEHICLE LOG-BOOK TRIAL ANNOUNCED On 4 September 2015 the Hon Duncan Gay MLC, Minister for Roads, Maritime and Freight, announced the launch of the 60 day classic log-book trial, due to commence from 1 October 2015. The Motor Accident Insurance Regulation Policy Branch has been working closely with the modified vehicles conditional registration scheme focus group on the new initiative, which brought together representatives from various stakeholder groups including veh...icle and industry bodies, Transport for NSW, Roads and Maritime Services (RMS) and SIRA (State Insurance Regulatory Authority). Historic vehicles may be registered normally without conditions if an operator wishes to use the vehicle for commuting purposes. Alternatively, historic vehicles may be registered under the Conditional Registration Scheme, which allows vehicles that do not comply with Australian Design Rules and vehicle standards to have limited access to the road network in order to perform certain functions. Some examples include agricultural vehicles, constructions vehicles, street rods, recreation vehicles (on Stockton Beach only), purpose-built vehicles, over-snow vehicles and historic vehicles. When a vehicle is registered under the Conditional Registration Scheme, RMS issues a Green Slip on behalf of the CTP insurer. Operators of historic vehicles who wish to register their vehicle under the Conditional Registration Scheme must be owners of a vehicle that is at least 30 years old from the date of manufacture, be members of an RMS recognised historic vehicle club and are limited to using their vehicle in conjunction with approved club events or for vehicle maintenance purposes. Under the 2 year log-book based trial, owners of over 30 year old vehicles that meet the safety requirements of full registration or the current Historical Vehicle Scheme will be able to opt-in via participating clubs for 60 days of general use each registration year. The current Historic Conditional Registration Scheme also remains unchanged as an option.

23.01.2022 Limitation on Weekly Workers Compensation Payments In 2012, amendments to the Workers Compensation Act introduced a limitation to the amount of weekly workers compensation benefits an injured worker may receive. Generally, an injured worker may only receive weekly payments for a maximum of 260 weeks.... Injured workers who were in receipt of weekly benefits as at the 1st of October 2012 are known as existing recipients. Calculation of the 260 week period for existing recipients did not begin until the 1st of January, 2013. For existing recipients, the end of the 260 week period is fast approaching. Many injured workers will cease to be entitled to benefits by the end of 2017 or early 2018. It is estimated that over 6,000 injured workers will be affected. To avoid this, you need to have at least 21% permanent impairment. The Workers Compensation Law allows for only one Medical Assessment Certificate to determine permanent impairment. However an existing recipient who has previously received an impairment rating of less than 21% is allowed to have one further assessment. If the further Medical Assessment Certificate assesses at least 21% permanent impairment, the 260 week cut off will not apply and the injured worker may continue to claim weekly benefits. Injured workers are now receiving letters about this from insurers. The letter generally advises workers that they are under 21% permanent impairment, they are reaching the 260 week limit and that weekly payments will come to an end after that time. 20.01.2022 VALE NICK FRISINA Nick Frisina studied law through the Solicitors Admission Board and was admitted as a solicitor on 9 November 1979. While studying law, Nick initially worked as an Articled clerk for Robert Johns & Associates, a solicitor in Revesby, New South Wales. He later had his articles transferred to J A McKelbing & Associates at Campsie, New South Wales.... During his articles with J A McKelbing & Associates, Nick gained a broad experience working in all types of matters under the supervision of his master solicitor, Mr Joe McKelbing. Shortly after he was admitted he answered a job advertisement for a city firm, J W Walton & Co. He commenced working for them, establishing their branch office at Cabramatta. Approximately 6 months later, Nick purchased the branch office located at 84 Broomfield Street, Cabramatta and he renamed it Frisina & Associates. Nick became a sole practitioner at just 24 years of age. The firm eventually moved to 119A John Street, Cabramatta in 1985 and then finally to 84 Bathurst Street, Liverpool in 2000. In 1985, Nick employed his brother, Anthony as a clerk and later as a solicitor. Nick became one of the first Accredited Specialists in Personal Injury Law in 1993. In 1996 Nick and Anthony entered into partnership. In 2007, Nicks daughter, Angela joined the firm as a solicitor. Nick & Anthony ran a successful and harmonious partnership for 20 years and 6 months until 31 December 2016, when he retired due to failing health. Nick was a great mentor to his brother and daughter. He was a wise and astute individual. He had an innate sense for what was right and true, and the prudence and judgment for sound decisions and advice. Nick was a highly principled and ethical man. He had an unwavering commitment to an honourable set of principles which he faithfully applied to every aspect of his life. Nick displayed great dignity, integrity and resolve in every action he performed and every challenge he confronted. Nick was an endearing character and worked to build and maintain relationships. Throughout his life, he developed great personal friendships and the respect of his peers. He had a profound love for his family and was a devoted husband, father and grandfather. Nick passed away on 20 January 2017. Nicks passing has left a void in the lives of his family, friends, and the legal profession. He will be forever missed. We wish to extend our sincere thanks to everyone who has offered their kindness, condolences and support during this difficult time.

19.01.2022 NICK FRISINA PARTICIPATING IN ST VINCENTS RESEARCH STUDY Nick Frisina has been invited to participate in a research study being conducted by Professor David Ma, Clinical Haematologist of St Vincents Hospital. The aim of the study is to improve quality of life and survival rates for transplant survivors. ... The research will investigate the potential physical and emotional benefits of delivering post-transplant interventions to patients, such as physical exercise and stress management, at home, using multi-media technology. The study utilises Internet technology to contact post-transplant patients via webcam and provide physical and psychological treatment, in place of requiring the patient to travel to St Vincents Hospital for that treatment. As a volunteer participant, Nick undertook a baseline fitness assessment at the commencement of the study and his fitness will be assessed again at regular follow-up sessions after 6 weeks, and 3, 6, 12 and 18 months. The results obtained from the study will provide important information on the best method of post-transplant care.

Tony, the staff in the ICU department were very appreciative and great full for your kindness. They kept asking us to thank you for your generosity. Without you we wouldnt of been able to do what we did. To the staff at the ICU department, thank you for all your hard work that you do every day and night. What you have all done through this pandemic (and even beforehand) is something that is beyond this world. Without all your hard work there would be so many people without the right care. The NSW Government says that the proposed changes will reduce the cost of CTP premiums. This is political spin. The real impact of the proposed changes will be to vastly restrict the compensation available to people injured through no fault of their own and to remove their entitlement to legal representation. ... Light the Night encourages participants to shine a lantern as they walk along the promenade of iconic Bondi Beach at sunset: a gold lantern to remember someone lost to blood cancer, white for a personal journey or blue to show your support for someone suffering from blood cancer. The aim of Light the Night is to improve the lives of families impacted by blood cancer through emotional and practical support, and raising funds for vital research.

15.01.2022 NSW GOVERNMENT SEEKS FURTHER REFORM OF WORKERS COMPENSATION LAWS The NSW State Government has introduced the Workers Compensation Amendment Bill 2015 into Parliament. The bill proposes amendments to workers compensation laws, which last underwent a radical overhaul in 2012. The current raft of amendments appear to take a slightly softer approach to reform of the workers compensation system. ... To a certain extent, the proposed amendments represent a step towards restoring some balance to the workers compensation system to the benefit of injured workers, resulting in a system that is less arbitrary and unfair. It is proposed to extend the time limit for payment of medical and treatment expenses. The proposed amendments for medical and treatment expenses recognise the unfairness of the current laws. The proposed amendments to claims for weekly compensation include: A worker who is injured before reaching retirement age may be able to claim weekly compensation for up to 12 months following retirement age (currently, the entitlement to weekly compensation ends at retirement age); An injured worker who has some capacity for work and who is assessed with greater than 20% permanent impairment will no longer be required to work for a minimum of 15 hours per week and earn a minimum of $176 per week (indexed) to be eligible to receive weekly compensation; and Injured workers will be able to access legal advice to challenge work capacity decisions however, the regulations which will govern this are yet to be released. The devil will be in the detail. The proposed amendments to weekly compensation entitlements widen the net of eligible claimants and results in a fairer outcome for some claimants. The proposed amendments to lump sum compensation include: The amount of lump sum compensation payable to an injured worker with permanent impairment will be increased, and indexed annually; The amount of lump sum compensation payable in respect of the death of a worker will be increased from $524,000 to $750,000; and The maximum amount payable in respect of the funeral expenses of a deceased worker will be increased from $9,000 to $15,000. There are no proposed amendments to lowering the permanent whole person impairment threshold, currently set at 11%. The bill is at present in the Legislative Assembly, awaiting the second reading debate, which was adjourned on 5 August 2015 for 5 clear days. Watch this space.

08.01.2022 Nick Frisina speaks at St Vincents Hospital Cancer Plan 2015-2020 Launch On 5 March 2013, Nick Frisina was diagnosed with Leukaemia after undergoing a routine blood test. The following day, he was admitted to St Vincents Hospital, Darlinghurst and commenced treatment there. ... Nick endured 8 cycles of chemotherapy and eventually required a bone marrow transplant. His eldest son, John, was his bone marrow donor. The bone marrow transplant was a success, and Nick is now in complete remission. Nick was recently invited to speak at the launch of St Vincents Hospital Cancer Plan 2015-2020 which was held at the Kinghorn Cancer Centre, Darlinghurst. The purpose of the launch was to outline the St Vincents Hospital 5-year plan for its cancer services, focusing on further improving cancer prevention, diagnosis and treatment and to achieve better care, survival rates, quality of life and support for people with cancer and their families and friends. The launch was attended by various dignitaries including NSW Health Minister The Hon. Jillian Skinner MP (pictured with Nick below). Nick spoke about his experience as a patient of St Vincents Hospital, in particular, the high standard care he received from doctors, nurses, and various other hospital service providers.

06.01.2022 ZURICH ADVISES STATE INSURANCE REGULATORY AUTHORITY (SIRA) OF ITS INTENTION TO EXIT THE CTP GREEN SLIP MARKET Zurich will no longer offer CTP Green Slip policies for sale from 1 March 2016. SIRA is assuring policy holders that their policies are still valid and will be honoured by Zurich.... In addition, third party compensation claimants will continue to be looked after. In its December press release, SIRA states: "The regulatory environment has been supporting seven CTP insurers for over a decade. Current insurers are AAMI, Allianz, CIC-Allianz, GIO, NRMA, QBE and Zurich. Although Zurich is exiting the CTP Scheme, the Scheme continues to remain viable and the market remains competitive." It remains to be seen what impact Zurichs exit from the Scheme will have on the cost of CTP Green Slip policies, if any.

03.01.2022 Changes to Motor Accident Compensation Scheme The NSW Government has recently passed legislation in the parliament which overhauls the NSW Motor Accident Compensation Scheme. There will be significant changes to the scheme which will reduce green slip premiums and reduce costs to the scheme in a number of ways. This is done with the introduction of statutory no fault benefits which the government says will reduce legal costs and the adversarial nature of the scheme as claiman...ts will no longer have to lodge a common law damages claim to get compensation for their injuries. There is a further reduction in costs by removing access to common law damages for soft tissue injuries and minor psychological/psychiatric injuries. Common law claims will be reserved for claimants with more serious injuries. A summary of the proposed changes can be found below: At Fault Drivers Presently claimants who are to blame for a motor vehicle accident cannot make a claim. However, under the proposed scheme an at fault driver may claim income support, medical and care benefits for up to 6 months. Injured Claimants Not At Fault Claimants who are not at fault for an accident who have suffered a soft tissue or minor psychological injury can claim limited benefits for income support, treatment and care for up to 6 months. All other injured claimants who are not mostly at fault will be entitled to additional income support, treatment and care. Claimants with a moderate injury (above 10% Whole Person Impairment) will be entitled to income support for up to 2 years. However, claimants who make a common law damages claim will be entitled to claim income benefits for up to 3 years. If a claimant has greater than 10% whole person impairment, income support will be paid for up to 5 years if a common law damages claim is made. Furthermore, moderately injured claimants will be entitled to receive reasonable treatment and commercial attendant care costs for life. Common Law Damages Common Law damages claims can be made where the injured person can prove fault (negligence) against an owner or driver of a motor vehicle, except in cases were the injuries are minor. The only damages that may be awarded are for: 1. Pain & Suffering where the permanent impairment is greater than 10%; and 2. Past loss of earnings and for future impairment or deprivation of earning capacity. A Common Law damages claim cannot be commenced earlier than 20 months after the date of the accident. However, proceedings must be commended within 3 years from the date of the accident. A Dispute Resolution Service will be established within the Motor Accidents Authority which will assess and attempt to resolve claims before they are referred to court. We will provide further information on the new scheme when information is made available.
