24.01.2022 There is a myth that all lawyers are the same. This is absolutely not true on many parameters. Here are the two main ones. First, there are different levels of COMPETENCY, which reflects in the quality of your representation.... Second, there are COSTS, which (quite frankly) hardly ever reflect the competency of the lawyer to deal with your case. In our case, we offer fixed prices, pro bono and payment plans to take the financial strain off of our clients.

20.01.2022 Today, guys, I have decided to start explaining you all the basics about Family Law in Australia. It is important to understand the terminology when you are trying to navigate your divorce process and not to rely solemnly on your lawyer. The first term in our #familylawdictionary is DEFERRED FEE. So, paying for your lawyers work is important, right? But sometimes it is difficult to keep it all together financially while trying to sort out your divorce and starting your ne...w life all at the same time. Thats why we offer our clients #deferredfee option, when you can get to use our services and get important stuff done, but pay later! You will have to pay for the expenses, of course, like court fees, barristers etc, but #Genuine_Legal will not charge you for the work until the case has finished! A small example: Our client found herself in a tricky situation after her partner decided to leave her completely empty-handed post-divorce. Having no means to pay for legal support, she chose the deferred fee route, and walked away with $270,000 as a result. There is always a way out. Genuinely yours, Evgeny See more

However, in order to do that one has to renew her diploma. She failed to do so.... Police wanted to send her to jail when she hasn't even commenced her work. Jason was successful in getting her a 9-month probation period. See more

16.01.2022 Did you know that the majority of private Family Dispute Resolution Practitioners / Mediators charge clients for hiring the venue? As a business, it is essential that we adapt and adopt new processes. This will allow us to lead the change and continue moving the industry forward. What does this mean for the legal industry?... Courts and consultations are shifting online. Changes originally intended to stop the spread of COVID have challenged conventions and streamlined the way we do business. Genuine Legal is a firm which is evolving with the ever-changing world. If you need representation for a family or criminal matter you need a qualified and adaptable team. 14.01.2022 The vast majority of the law firms charge per hour. Sounds fair? Many professionals in different areas charge per hour. However, from our experience given the complexity and unpredictability of family law matters hourly bills can raise rapidly to tens of thousands. Another problem is that hourly charges are hard to measure from the clients perspective. A client does not have control over the bills. This can leads to untrust between a lawyer and a client. Many clients compla...in that hourly rates costs agreements give Lawyers rights to "charge what they want". Hourly rates also do not allow offering a Payment Plan because a client would always be behind. This builds anxiety, mistrust and debt. Lawyers spend a lot of time chasing up arrears rather than on real work. This is one of the reasons why many law firms request large amounts of money upront. We are of the strong view, that the hourly charges system in family law matters is wrong and negatively affect lawyer-client relationships. We are a large firm and exclusively practise Family Law. We stand for 100% fixed fee. A fixed fee is an agreed fixed amount to be paid for the agreed work. It does not matter if we have spent more time on the matter. A fixed fee cannot be increased. This is our promise. We will provide you with a fixed fee quote. Usually, it is possible to provide you with our fixed fee quote after attending a 1-hour free consultation. For complex Court matters, we will be able to give you a fixed fee quote for a particular stage of your case. We have all prices on our website. I am not sure whether any other law firm has a full price list openly on a website. Because of the fixed fee model we are able to offer clear Payment Plans. We actually never ask for the full fees to be paid upfront. A small initial deposit, usually $500 - $1,000 is sufficient to commence work on your matter and represent you. We also offer "zero deposit" if you cannot afford one. All our clients are eligible for a Payment Plan. We neither have selection criteria, nor do we charge an interest rate with the plan. About 60% of our clients are on Payment Plans. Usually, a Payment Plan is $75 - $150 per week. Please comment below your opinion about how legal fees should work in family law matters. Feel free to share your experience. See more

08.01.2022 Living Under One Roof with an Ex: Legal Pitfalls For some separated couples, living under the one roof may be convenient in the short term, but can cause legal implications. It is not generally advised for ex-couples to remain living together as this may lead to further issues and take a toll on the emotional and psychological wellbeing of either party. One of the most important legal pitfalls that may arise is determining the actual date of separation, and parties may be in ...dispute over this. Defacto couples must commence a property settlement within two (2) years of separation. Married couples must have been separated for at least one (1) year prior to applying for a divorce. The separation date may also affect property settlement matters, where either of you have sold or gained assets prior to separation. Did you know? The law recognises that ex-partners may be considered separated and still residing at the same place of residence.
07.01.2022 #familylaw term of the day - Airport Watch-list. In short, it is a restriction preventing a child from leaving the Commonwealth of Australia, as a form of precaution. It is used if the child is at risk of being taken from the country away from the parent without their knowledge or consent. It's usually done by making an application with the Federal Circuit Court of Australia or the Family Court of Australia.

03.01.2022 At what age does a child have rights not to see a parent? A child is legally a minor until he/she turns 18. However, if your child refuses to see the other parent due to any extreme circumstances, it is crucial for you to document any communications with the co-parent, so you can build your case.... The court will aim to make a decision based on all the factors to come to a conclusion that is in the child's interest. For example: their statements will be seriously taken into account, but their understanding and maturity levels will also be evaluated.
02.01.2022 Do the Courts Always Side with Wives Over Husbands? There is a shared misconception that the Courts favour women's interests over men in family law proceedings. This could not be further from the truth. When making decisions in regards to property and parenting matters, there are many factors that the Courts have to consider and a party’s gender is not one of them.... One of the leading factors that drives the Courts' decisions is the child’s best interests. Other include contributions made by each party, as well as future needs.
