However, from our experience given the complexity and unpredictability of family law matters hourly bills can raise rapidly to tens of thousands. Another problem is that hourly charges are hard to measure from the clients perspective. A client does not have control over the bills. This can leads to untrust between a lawyer and a client. Many clients compla...in that hourly rates costs agreements give Lawyers rights to "charge what they want". Hourly rates also do not allow offering a Payment Plan because a client would always be behind. This builds anxiety, mistrust and debt. Lawyers spend a lot of time chasing up arrears rather than on real work. This is one of the reasons why many law firms request large amounts of money upront. We are of the strong view, that the hourly charges system in family law matters is wrong and negatively affect lawyer-client relationships. We are a large firm and exclusively practise Family Law. We stand for 100% fixed fee. A fixed fee is an agreed fixed amount to be paid for the agreed work. It does not matter if we have spent more time on the matter. A fixed fee cannot be increased. This is our promise. We will provide you with a fixed fee quote. Usually, it is possible to provide you with our fixed fee quote after attending a 1-hour free consultation. For complex Court matters, we will be able to give you a fixed fee quote for a particular stage of your case. We have all prices on our website. 08.01.2022 Living Under One Roof with an Ex: Legal Pitfalls For some separated couples, living under the one roof may be convenient in the short term, but can cause legal implications. It is not generally advised for ex-couples to remain living together as this may lead to further issues and take a toll on the emotional and psychological wellbeing of either party. One of the most important legal pitfalls that may arise is determining the actual date of separation, and parties may be in ...dispute over this. Defacto couples must commence a property settlement within two (2) years of separation. Married couples must have been separated for at least one (1) year prior to applying for a divorce. The separation date may also affect property settlement matters, where either of you have sold or gained assets prior to separation. Did you know? The law recognises that ex-partners may be considered separated and still residing at the same place of residence.
