Until recently, the law was that you could cut off overhanging branches, but then had to throw them back over your neighbour's fence. This often caused more bad feeling than actually lopping the branches. Since 2011, the law has changed. Now, if branches overhang your property by more than 50cm and are no more than 2.5m from the ground, you can remove them yourself but do not have to return the cut branches to your neighbour. 23.01.2022 Roadside #drug testing allows a #police officer to swab your mouth for saliva. This is an easy and simple process that only takes a short time to complete. You are required to follow the direction given by a police officer, as if you do not comply with instructions to provide a sample, you may be penalised. The saliva sample will be tested for any trace of THC, MDA or #methamphetamine in your system. If the roadside swab test returns a positive result, you must go to a police... station for a second saliva test. Whilst at the station, a similar procedure will occur where a swab of saliva will be taken from your mouth and tested for traces of various illicit drugs. If any trace of an illegal drug is found in the second sample, this will result in an immediate suspension from driving for 24 hours and you will be charged with the relevant traffic and drug driving offence. It is not only illegal drugs that are tested for. An officer is also allowed to request that you provide a sample of your blood for testing purposes, if the officer believes that any legal drugs have impaired your ability to drive safely. If this is the case, you may be faced with drug driving charges if you are operating a vehicle after taking medication such as painkillers or cold and flu drugs that contain pseudoephedrine. 18.01.2022 Can a Will be changed? The simple answer is yes. A will only 'speaks from the date of death', meaning that, as long as the #testator retains capacity, a will can be changed at any time. As a matter of prudence, we recommend that you review your will every two to three years, just to ensure that it still meets your wishes. A will is automatically revoked by a later inconsistent will. It is usual to include a clause in a new will expressly revoking any earlier ones. A will is ...revoked by marriage unless it has been made before the wedding and expressly states that it is made in contemplation of marriage to a named person. Divorce or the termination of a civil partnership does not revoke a will, however any gift to the divorced spouse or former partner is treated as if that person had died before the testator. A will can also be revoked by the testator deliberately destroying it with the intention of revoking it. Of course, what the testator's intention was is very difficult to prove, especially if a new will has not been made. 07.01.2022 Most #Queensland employees will be covered by the Fair Work Act 2009 (Cth) (FWA). The FWA applies to people who are employed by a 'national systems employer', which includes a 'constitutional corporation' and the Commonwealth insofar as it employs people. Shortly after the FWA was introduced, the Queensland government enacted legislation referring much of its powers to the Commonwealth and expanding the definition of 'national systems employee'. The combined effect of these Acts on employment law in Queensland is that now almost all employees in Queensland, with the exception of employees who are employed by the Queensland government, will be covered by the FWA.
