24.01.2022 *** Immigration news*** Skilling Australians Fund to commence on 12 August 2018 New charges will apply to the following applications from 12 August 2018:... - nominations that relate to temporary work visas incur a charge of AUD 1200 per year of the proposed visa period or, for businesses with an annual turnover of at least AUD 10 million, a charge of AUD 1,800 per year of the proposed visa period. Applies to visa TSS subclass 482 and visa 457 nominations. - nominations that relate to permanent visas incur a once only charge of AUD 3,000 or, for businesses with an annual turnover of at least AUD 10 million, a once only charge of AUD 5,000. Applies to : ENS visa 186 and RSMS 187 - an exception applies to labour agreement applications, with the charge being NIL, providing for the nomination of the occupation of Minister of Religion or Religious Assistant. The charges will replace requirements placed by the Migration Regulations for sponsors to provide evidence of training expenditure: - the equivalent of at least two per cent of their business payroll in contributions to an industry training fund (training benchmark A); or - the equivalent of at least one per cent of their business payroll on the training of Australians (training benchmark B). 23.01.2022 Work rights in Australia It is a criminal offence in Australia for employers to hire foreign employees without work rights. Companies face fines up to $126,000, also fines would apply to the people working illegally - they will be deported and never allowed back if caught not having the right to work. Visitor visa does not allow people to work, even for short periods of time.... If your business needs employees from overseas for short projects, the most appropriate visa is visa subclass 400, temporary work stay visa. It will allow your overseas employee to stay 3 months, and in some cases even 6 months. The complex issue that may arise with visa 400 is showing that the work is highly specialised and that the applicant needs to be in Australia to perform the work and that it will have to be for longer than the standard 3 month visa duration. 23.01.2022 Good news for partner visa applicants !? According to recent SBS report, The Department of Home Affairs has slashed the global processing time for partner visa applications to nearly half. 16.01.2022 The Northern Territory is continuing to be of great interest to potential migrants and students 117 occupations are now open for skilled migrants willing to migrate to Northern Territory through the DAMA program. The DAMA allows low skilled migrants with limited English to have the option to apply for permanent residency after living and working in the Northern Territory for at least three years. The DAMA is an employer-sponsored visa program and individual workers cannot app...ly for a visa independently. Those who don't have an employer willing to sponsor them, and therefore don't qualify for the DAMA program may choose another pathway, through studying there. If you are an eligible graduates who has undertaken at least two years of tertiary studies, leading to one or more qualifications while living in the Northern Territory, you can apply for the Skilled Regional Nominated (Provisional) (Subclass 489) visa or Skilled Nominated (Subclass 190) visa. 15.01.2022 Temporary visa holders in Australia are allowed to access superannuation as coronavirus support. Up to $10,000 can be withdrawn in the financial year 2019-20 and again in 2020-21. Your visa should have been active for at least 12 months and your financial hardship must be proved by documents that show significant loss of income, overdue bills, unpaid rent, inability to buy food and essential items etc.... The release of superannuation will be decided on a case-to-case basis. Applications to access superannuation funds can be made on https://my.gov.au/ 20 April onwards. 15.01.2022 There are 3 important things about DAMA Program that employers need to be aware of: 1. DAMA Program is a type of Labour Agreement and therefore has limited available places per annum. 2. To take part in the DAMA Program employers need to be approved first to be part of the Labour Agreement. ... 3. There is currently only one overarching DAMA in place to cover the Northern Territory. Labour Agreements are a great option for employers who are unable to fill both skilled and semi skilled occupations that have been identified as being in shortage. Also, concessions can be negotiated on skill level, English language ability and salary level of the overseas workers. There are also other types of Labour Agreement that employers can enter into. The Senate has just passed the Migration Amendment (Regulation of Migration Agents) Bill 2019, Schedule 1 of which is informally known as the "Deregulation Bill".... Schedule 1 of the new legislation abolishes the dual regulation of lawyers who practice as Registered Migration Agents, with the result that lawyers will no longer be regulated by OMARA, but only by their law societies. Whats next? 1 - The new legislation must receive the Royal Assent 2 - Schedule 1 of the new legislation commences on a single day to be fixed by Proclamation. 01.01.2022 Red Cross announcement - Assistance to Temporary Visa Holders The Red Cross has announced on its website that it will be receiving funding from the Australian Government for the next six months to deliver emergency relief and casework support to temporary visa holders who have no way to support themselves and who have urgent needs. The funds have not yet been received and the Red Cross will work as quickly as possible with the Department of Social Services to finalise the det...ails of the funding and expand assistance to people who are experiencing significant vulnerability. Assistance will include food, medicine and crisis accommodation costs. Who is eligible? Visa holders may be eligible for Red Cross Safety Net support if they: are in Australia on a temporary visa are in urgent financial hardship cannot access Centrelink, Medicare or similar services have no income, savings or other financial support (including from family overseas). Eligible visa holders are requested to contact the Red Cross by email in the first instance so that can be advised when the funds and arrangements are in place.
