25.01.2022 Wills are active until you die, make a new one or revoke an existing Will. Additionally, a marriage or divorce will revoke a Will, unless it was made anticipating that event. You should seek legal advice if your personal situation changes in any other way, such as children being born or relatives passing away.... You may change your Will at any time as long as you have mental capacity. However, this must be done legally correct by creating a separate document called a codicil and have it signed and witnessed in the same way as the original Will. Its not valid to simple cross something out on an existing will.

23.01.2022 In Queensland, as soon as both parties sign the contract and you receive your copy of the contract of sale, both you and the seller are bound to the terms of that contract. Although there is a cooling off period of five days, we advise you dont sign the contract until you are completely satisfied with the contract, as the seller is entitled to 0.25% of the purchase price if you withdraw.

17.01.2022 Conveyancing Guide - Settlement This is when you exchange the money and all the legal documents, so you can take ownership of the house. On the settlement day, you will need to have a final inspection, receive the keys and your conveyancer will do a final search with the official offices.... After the settlement goes through, your conveyancer will let you know it went through. The conveyancer will then organise the final details. After this, time to open the champagne, Congratulations, you are the house owner!

16.01.2022 Once you have found a property you are interested in buying, you should request your solicitor to examine the contract. This ensures that your interests are being protected. Its important that you come into buying a property with as much information about it as possible. This may include having a builder and pest professional inspect the property. An alternative is to have the contract subject to these inspections. Also to ensure that you have the time frame required to obta...in finance. When you reach an agreement with the seller, the contract is drawn up and signed, the real estate agent involved in the sale usually creates the contract. You can confide in your solicitor about any requirements you have, along with future plans for the property. This will help your solicitor in inserting specific conditions.

16.01.2022 The Deposit The amount you pay for deposit is negotiated. Remember that the higher the deposit, the more attractive it is to the seller (useful information when there are multiple buyers making offers). The deposit should be paid into the real estate agents account. You are better off not giving the seller any money until you own the house.... If you cannot financially pay the deposit, you may explore buying the option of a Deposit Guarantee Bond. It ensures that breaching the contract, you wont forfeit the deposit as the guarantee will pay it for you.

13.01.2022 What is a Will & why do I need a Will? A Will is a legal document that gives instruction of how you would like your assets to be distributed after you die. Wills are for everyone, not just people who own lots of property or money. ... If you do not have a Will, you dont have a say about how your estate or assets will be distributed. If you die without a Will, a legal formula is used to distribute your assets to relatives, and in some cases, the government. This often results in complications, additional fees and delays for those left behind.

13.01.2022 Conveyancing Guide - Paying Stamp Duty Stamp duty must be on the contract with 30 days of the contract being finalised. The reason for this is because it is essential for the registration of the mortgage, and the lender will be eager to register the mortgage as soon as possible. It is calculated on a sliding scale.... Remember, if you are a first home buyer, you may be eligible for the First Home Owner Grant and a stamp duty concession.
