09.01.2022 Five important immigration changes in Australia in 2019 1. Longer processing times for partner visas Because the Family Violence Bill passed in the Senate last November, partner visa sponsorships need to be approved first before applications are lodged. This means that potential offshore applicants and sponsors will have to pass through a stringent process to assess their character and history. This will then prolong the process of obtaining a partner visa.... 2. An introduction of a new temporary sponsored parent visa This year, Australian citizens and permanent residents will be able to bring their parents from overseas to Australia. Only 15,000 visas will be granted each year. Once approved, these parent visas will be valid for three or five years, costing $5,000 and $10,000 respectively. The said visas are renewable, but only up to a maximum of 10 years when combined. 3. An increase in show money for foreign students to more than $20,000 This year, students have to be able to provide evidence of funds of around $20,290. Bringing in a partner is an additional $7,100 and an additional $3,040 needs to be provided for each child. 4. Matching ATO tax records to salaries of employer-sponsored migrants This year, the Department of Home Affairs will be cracking down on companies underpaying employer-sponsored migrants. In partnership with the ATO, the department will be gathering the tax file numbers of those who currently hold a 457/482 TSS visa in order to match them with current tax records to make sure that the said migrants are being paid the right amount based on their nominated salary. 5. South Australia visa for start-up entrepreneurs The state is set to pilot a new visa for start-up entrepreneurs which isnt as difficult to obtain as a Business and Innovation visa. The said visa doesnt require a $200,000 funding arrangement and only a 5 average band score on the IELTS. Applicants are required to provide the state with an original idea and business plan in order to obtain this visa. For more information, visit the Department of Home Affairs website.

03.01.2022 Department of Immigration and Border Protection (DIBP) have released the new Skilled Occupations List (SOL) for 2016-17. This list will come into effect from 1s...t July, 2016. The Skilled Occupations List is used for 189 (Skilled Independent Visa), 489 (Skilled Regional Provisional Visa) and 485 (Graduate Temporary Visa) visa applications. 03.01.2022 7-Eleven shows why overseas workers need more help understanding their employment rights and conditions The Migration Institute of Australia (MIA) welcomes the recent investigation and legal action being taken by the Fair Work Ombudsman into 7-Eleven franchisees. Some 7-Eleven franchisees have allegedly been severely underpaying their workers, many of whom are here on international student visas says MIA National President Angela Chan FMIA. As detailed in the joint ABC 4 Corn...ers and Fairfax investigation aired last night, it is alleged that 69 per cent of 225 audited 7-Eleven stores found ongoing payroll issues. In many of these stores, a half pay scam was being used where many workers were working 40 hours, but their submitted timesheets to 7-Eleven head office showed only 20 hours of recorded work. This resulted in these workers being paid as little as $10 per hour. In many instances the employees were employed on a student visa, which allows an individual to work up to 40 hours per fortnight. As reported by the ABC, the students were allegedly threatened with losing their visa if they complained to the authorities. The many breaches of overseas workers rights in the 7-Eleven case is completely unacceptable. This case raises many questions about how so many overseas workers could be exploited for so long and the actions of the government to ensure their working rights, said Ms Chan. In order for overseas workers coming to Australia to protect their consumer rights, Ms Chan notes the best action to take is acquiring the assistance of a Registered Migration Agent who is an MIA member. MIA members can help make overseas workers aware of their working rights and what pathways are open to them if they feel they are being exploited. The pathways for overseas workers to get information to better understand their working rights in Australia needs to be simplified, so that cases like the 7-Eleven one does not reoccur, said Ms Chan. MIA supports the work of the Department of Immigration and Border Protection and the Fair Work Ombudsman to crack down on employers of overseas workers who have underpaid their staff and broken the law. The consequences for breaking such legal requirements and workplace responsibilities need to be crystal clear to employers when they hire overseas workers. Every effort must be made to provide the employer and the employee a fair go, said Ms Chan.
