25.01.2022 "Pitchfork-wielding mobs have always existed, but never have they been able to form in a matter of minutes and get people fired within hours. The speed of outrage on the internet moves so quickly that we could tweet something at the breakfast table before heading out the door for work only to find that when we arrive we don’t have a job. Whether we like it or not we are all governed by this rapid-growth wrath and the possibility that expressing our honest opinions on social media could destroy our careers." https://quillette.com//inducing-peoples-employers-to-fire/

22.01.2022 If you own a website that enables consumers to review your products or services and you are tempted to allow only good reviews, think again. You may be breaching the law. In July 2018, Meriton Serviced Apartment was fined $3 million by the Federal Court for manipulating the reviews it would receive by implementing a practice of ‘masking’ email addresses that prevented guests Meriton suspected would give negative reviews, from receiving TripAdvisor’s ‘Review Express’ prompt email. Such behavior was found to be misleading or deceptive conduct and conduct liable to mislead the public which is prohibited under the Competition and Consumer Act 2010.

17.01.2022 The Full Federal Court has clarified what a liquidator may do where a company Director on the run fails to attend a s.596A Summons for examination in a situation where the liquidator has difficulty establishing that the director was served with the Summons or even that he was aware of the Summons. The Court has held that nonetheless, a Liquidator may apply and be granted a warrant to arrest the director to bring him/her before the Court. The issue of Service or the Director's knowledge of the Summons is only relevant once the Director is brought before the Court and wishes to raise an excuse. The same principle is also applied where the liquidator applies for an arrest warrant for contempt of court. See Mensink v Parbery https://jade.io/j/?a=outline&id=594173

13.01.2022 "if someone is making wrongful, unjustified, or just plain nasty comments about me what can I do?" We at Jude Lawyers have acted many times to assist in taking down and stopping defamatory statements being made or published against our clients and obtain compensation for damages in some instances. Below is a link to a good article simply explaining the initial steps that may be taken. https://www.mondaq.com//libel-defamation/987600/defamation

04.01.2022 Facebook sledging of your Ex Partner can be Defamatory and cost you $thousands. Dabrowski v Greeuw (2014) WADC 17 "Greeuw posted to her personal Facebook page the comment: "separated from Miro Dabrowski after 18 years of suffering from domestic violence and abuse. Now fighting the system to keep my children safe." Dabrowski sued for defamation. "Defamatory publications on social media spread easily by the simple manipulation of computers. A public Facebook page is able to ...be viewed worldwide by whoever clicks on that page and the grapevine effect stemming from the use of this type of medium must be considered (ref Mickle v Farley). However it must also be recognised that Facebook is a source other than a mainstream news or information provider." Dabrowski was awarded damages of $12,500. This was despite the fact that there was no financial loss, the remarks were made by an estranged spouse to a limited audience, and removed after 6 weeks." extract from https://www.mondaq.com//defamation-the-social-media-social See more

03.01.2022 Do you have a current Will? It is understandable to be concerned about the Coronavirus as there is a possibility that many of us may become infected (despite all precautions) and end up in hospital or be quarantine without a current Will or Power of Attorney/Advanced Care Plan? This may therefore be the time to prepare. This especially where you are the main income earner, have children and dependents, operate a business or are the sole director/shareholder of a company. It... is difficult enough when an ordinary person dies intestate. Family and other beneficiaries may be left waiting for letters of administration to be granted years after your death. Unwanted strangers may be appointed as administrators by the Court and expensive time consuming disputes may arise. If you have a business that is operated as a sole proprietorship or you are a single director/shareholder of a company operating a business, dying intestate may make things even more complicated for survivors as the death will usually leave the business without anyone with legal authority to manage the business and make financial or other business decisions. This could leave the business hamstrung and cause significant uncertainty and distress to employees and clients of the business. Equally in the situation where you find yourself confined to hospital or in quarantine and are unable to attend to business, make decisions and even perform regular banking, you may be left with no access to your own money and be unable to care for or maintain your loved ones, your business, your companies and even yourself. This may therefore be an opportune time to contact Jude Lawyers today to prepare and manage the risks currently at our door and to ease the concerns of our dependents, partners and employees.
