19.01.2022 Failure to Perform - One of the most common problems experienced by businesses during COVID-19 is failure by parties to perform obligations. If you are uncertai...n as to your rights, or unable to resolve a dispute, we can tell you where you stand and ‘bat’ on your behalf. This law can be complex: we may need to construe terms of a contract or apply common law; we may need to identify a remedy outside of contract law, such as ‘restitution’. Rest assured we can help you in plain English. You can contact us by direct message, email or telephone on 07 4031 7133. Queensland Law Society Photo by Matthias Oben from Pexels

16.01.2022 I commend Melia Benn’s speech regarding the recent decision of Love v the Commonwealth. In light of the current controversial climate, the insights from indigenous women that Melia provided against extracts of the judgement are timely, thought provoking and educational. Well done to Melia and the other presenters! It is disappointing to hear and see ignorant statements in current public discourse to the effect of ‘moving on and not dwelling in the past’. The leaders of ou...r First Nations people are still striving for recognition, as seen in the Uluru Statement from the Heart (referred to by Melia). These topics are certainly not widely understood well within our community. I hope that there can be greater education, awareness and respect, constructive discussions and positive outcomes for all (and quashing of the hate fuelled and nonsensical statements). Here is the video: https://lnkd.in/gKB9y2x The below link will take you to Melia’s paper. Monash University

02.01.2022 Contrary to popular belief, company and business name registration does not mean that you own your brand’s name nor does it mean that you can stop other people using your brand. Intellectual property laws apply. If you are interested in trade marks and what else you may need to consider, contact Kim at [email protected]. #intellectualproperty #trademark #copyright #brand_lawyer
