23.01.2022 Today our client was found Not Guilty of aiding and abetting a Central Coast based "body modifier" in the removal of the labia minora of an adult female complainant. There was never any suggestion by the Prosecution that our client played a part in the physical procedure. The complainant consented to the procedure and had engaged in several other voluntary body modifications previously. Our client had serious concerns about this "body modifier" and reported his conduct to the... police and other agencies on numerous occasions prior to this procedure. Those agencies took no action at the time. Despite our clients efforts to blow the whistle and expose this behaviour, he was charged. 22.01.2022 4.5 years ago, our client lost his career and reputation when he was charged with over 20 counts of criminal conduct involving corporate corruption, fraud and dealing with the proceeds of crime. He faced a significant term of imprisonment if found guilty. Last week, Korn MacDougall Legal started week 1 of what was expected to be a 3-month trial at the Downing Centre District Court. 20.01.2022 Yesterday we appeared for Gary Jubelin, the former lead investigator in the William Tyrrell case, who was convicted and fined $10,000 in April after a magistrate found he illegally recorded four conversations during the investigation into the toddlers disappearance. He is appealing against the sentence and findings of guilt in the District Court. A decision will be made on 18 September.

19.01.2022 On Friday 14 February 2020 the Gary Jubelin hearing concluded in the Downing Centre Local Court. His Honour, Magistrate Hudson will hand down his decision in April. Jubelin is charged with unlawfully recording conversations with a witness in the course of his investigation into the disappearance of William Tyrell. Lauren MacDougall was quoted in Sundays Telegraph: "Jubelins Solicitor, Lauren MacDougall, said in many of her criminal cases, the Crown argued for courts to adm...it illegally obtained evidence because it was valuable to their case. For example, if a random police search of a car turned up drugs, the Crown might argue for the court to admit the evidence even though the search was technically unlawful. Jubelin, she said "is being pursued by (the DPP) which so very often relies upon illegally obtained evidence on the basis that even if it was illegally obtained, it allows prosecutors to pursue and convict wrongdoers" See more

17.01.2022 In a New South Wales first, the idea of Gel Ball Blasters fitting the definition of firearms under the firearms act has been successfully challenged, setting a precedent for these items in the future. Mr Towner runs the business Armoured Heaven, a seller and online distributor of toy guns and other memorabilia and collectable items. After 7 years of trading Mr Towner was charged in March 2017 for the possession and sale of firearms. After 3 years of this case being before the court, It took the Jury only 26 minutes to return verdicts of not guilty to 66 charges acquitting Mr Bradley Towner of all firearms offences. 17.01.2022 In July last year we appeared at Armidale District Court for a client who pleaded guilty to the supply of 78.9 grams of methylamphetamine. Gaol was an available sentencing option, but Judge McLennan afforded our client the opportunity to demonstrate a positive and necessary approach to rehabilitative treatment. On 1 March 2019 the matter returned to Court and Judge McLennan sentenced our client to an Intensive Corrections Order. Meaning he avoided full-time imprisonment and can serve his sentence in the community. He said this to our client: This outcome is due partly to persuasive advocacy of your Counsel but mostly because of the effort you put in from July to today Sensible and practical justice in action.

14.01.2022 After a two week trial in the Moree District Court our client was today found not guilty of dealing with over $400,000 cash that the Crown alleged was the proceeds of crime. Our client was pulled over as part of a random breath test operation while driving from Brisbane to Melbourne where the money was ultimately found in a compartment in the cargo area of the van he was travelling in. Apart from His Honour ruling that the search of the vehicle was illegal he held that the Cr...own could not establish that he was guilty of the offence and returned a verdict of not guilty. An excellent result and a just outcome for a client who has always maintained he had no knowledge of the money found by Police. 12.01.2022 "...The man, known as "RB", denied the allegations. He argued he should be allowed to introduce evidence of 12 incidents in which the woman made false complaints about sexual abuse. This included two separate incidents in which she made false reports to police, promoting sexual assault investigations that ended in her admitting her allegations were fabricated. After the second incident she was charged and pleaded guilty to making a false report to police. The Judge said the... history of false complaints was relevant to the trial, but he could not allow the evidence to be introduced" ...Do you think this man is getting a fair trial?

10.01.2022 8:3:2019 - A nice ending to a busy week at Korn MacDougall - today at Orange District Court, Judge Norton allowed our clients Appeal resulting in him being released to Parole today rather than in October this year. The crux of the Appeal was that the Local Court failed to take into account his complex medical condition and regard it as a special circumstance in the sentencing process. Her Honour regarded his time in custody to be unacceptably burdensome on both him and the community. #kornmacdougall
08.01.2022 Yesterday our client, Yunxiang Gao was found Not Guilty by a Jury in relation to multiple charges of sexual assault. Our client lost his reputation, his career and was forced to spend 2 years away from his home in a foreign country under strict bail conditions. Some of the Jury broke down in tears as their verdict was delivered. Mr Gao has a long way to go to rebuild his life but we are so pleased we were able to achieve this result for him after a very difficult few years. 03.01.2022 This morning Lauren MacDougall appeared at Central Local Court for a man who was arrested at Sydney Airport this week. The Prosecution initially opposed bail on the basis that our client was a flight risk. However, 24 hours later they changed their attitude after we prepared evidence demonstrating our clients ties to the community in Australia. Bail was granted.

02.01.2022 This week L MacDougall appeared in the Gosford District Court for a client who was charged with knowingly taking part in the large commercial supply of prohibited drugs in 2014. Our client denied any involvement in the supply. We made offers to the Prosecution on several occasions to plead guilty to a different offence, that is, dealing with the proceeds of crime. The Prosecution would not accept our offers. Something (finally) clicked and after the commencement of the trial ...this week, the Prosecution invited us to make the offer again. Our client made the decision to plead guilty to the offence he offered to plead guilty to years earlier. The supply charge was withdrawn and he received a good behaviour bond. A costs argument followed and the Judge awarded costs to our client - recognising the financial burden defending a prosecution that was doomed from the outset. See more
