24.01.2022 Why its never too soon to do a property settlement after you separate! At our recent free Family Law information session, I covered the issue of property settlement and why you should seek legal advice early and formally resolve financial settlement as soon as possible. Firstly, having been separated myself, I get it! The first few months at least are about dealing with the practical issues, emotions, wondering if you might get back together, learning to parent solo and jus...t keeping it together. But let me tell you about a case I had a few years ago. Peter who was about 50 years old came to me after his ex-wife initiated proceedings against him for property settlement 10 YEARS AFTER the marriage ended. When I asked him why he didnt sort out a settlement years ago he said, I thought shed come back. Theres no doubt Peter was an eccentric bloke, who clearly loved his ex-wife and put his heart ahead of common sense. Whether he actually believed she was coming back, or simply thought she would never make a claim and it would all go away, the fact remains he made a huge mistake! His ex-wife re partnered up and lawyered up, yes that right 10 YEARS later and initiated proceedings to get her slice of the matrimonial property pool. I represented Peter and his matter did settle without going to a trial within a reasonable time. But lets take a look at what he lost. His humble little workers cottage close to the city had appreciated by a massive amount in that time, he had no real money in the bank and had to sell a favorite classic car to fund his legal fees, he spent $12,000 in legal costs and ended up having to sell his home to pay out his ex-wife. The lesson in this story is simple. Dont be like Peter! Over time assets particularly property and superannuation appreciate, the longer you leave it the greater the property pool you have to split and essentially the more you lose over the long run. Some people dont think they need a property settlement if they dont own property together WRONG. Superannuation, particularly if you have been working for a long time and have a healthy balance is an asset that requires formal division. If you have been separated, are clear you are not reconciling with your ex-partner, do yourself a massive favor and book in to see me for an initial consultation for up to 3 hours for $400. 21.01.2022 Covid -19 and its impact on Family Law Court hearings New government restrictions have resulted in significant changes in the way in which hearings are being conducted by the Family Court and the Federal Circuit Court. These changes have been put into effect to protect the health and safety of the community, profession and court staff, whilst continuing to provide this essential service. What is the new process?... The Courts Registry Service have advised that remote service by phone and through online services is now in place. Most court hearings will happen by phone and where possible by video link. The Court has issued Practice Directions to the legal profession to streamline the Court process and to limit physical appearances at the courtroom. The Court is encouraging the use of the Commonwealth Court Portal to file documents electronically. Legal representatives are assigned dial in details and are able to make submissions to the presiding Judge by phone. The Court can also invite clients and unrepresented parties to dial in to these hearings. What about Contested Hearings? The Courts have suggested that they will arrange a telephone listing for those matters that are being contested in the next two months. New procedures for high priority contested hearings includes limiting the amount of face-to-face time in Court to one and half hours and possibly conducting part of the hearing by phone. Other matters of lower priority are likely to be sent to Mediation or another type of alternate dispute resolution event, with the Trial Date to be adjourned to another date to be advised. Other matters may require the court to deal with the matter in a different manner including adjourning the matter and: - - requiring the parties to participate in a family report interview or child inclusive conference; - requiring the parties to adhere to temporary orders and provide updated affidavit material. Here is a post about why you should be wary what you post on Facebook when going through a family separation law case. Section 121 of the Family Law Act imposes a widespread prohibition on the publication of any part of family law proceedings. The provision makes it unlawful (subject to exceptions) to publish information t...hat identifies any person who is a party to such proceedings or who is otherwise connected to proceedings. What about recording private conversations? In Queensland, Victoria and the Northern Territory, it is not a criminal offence for a party to a private conversation to record that conversation without the consent of the other participants, but it is an offence in those jurisdictions to publish that recording unless permitted in limited circumstances including in legal proceedings. Please be aware that different laws apply in other states and territories in Australia.
