25.01.2022 Discussion: Is the current severe lockdown in Victoria legal?

25.01.2022 "The danger of adding to general criminal laws in a crisis is the potential over-criminalisation of the general public," professors Lorana Bartels and Felicity Gerry write.

24.01.2022 The High Court has quashed George Pell’s conviction. Obviously, there’s no appeal from here so this is a final decision.

24.01.2022 In the midst of Australia's bushfire catastrophe and in the shadow of the failure of successive governments to act on warnings by scientists, ALA member Greg Ba...rns argues that it will only be a matter of time before the courts are forced to step in as they have done with Big Tobacco and Big Pharma. 21.01.2022 Plaintiff lawyers may soon be able to take a percentage of the settlement of a class action, instead of charge clients an hourly rate or a fixed fee. ALA Victor...ian president Jeremy King said the change would protect clients. 'It will clearly benefit vulnerable and disadvantaged individuals who may otherwise be unable to pursue a claim because of the cost,' Mr King said. At the moment, unless a law practice is willing to act on a ‘no-win, no-fee’ basis or clients buy insurance, if a class action is unsuccessful the plaintiff risks being personally liable for paying the defendant’s costs.

21.01.2022 This is an article from 5 years ago but the discussion is relevant today. Are state and federal governments liable for failing to deal with fire control and prevention, and climate change?

21.01.2022 From VCAT: Coronavirus (COVID-19) response Posted on 17 Mar 2020 In the interests of public safety and in an effort to implement social distancing measures, VCAT has moved to conducting hearings by telephone. As a result, VCAT venues will be closed to the public until further notice.... No face-to-face hearings have been scheduled for Wednesday 18 March 2020, and all non-critical matters have been adjourned for the time being. Residential Tenancies and Guardianship matters (and a small number of other critical matters) will be heard by telephone. We are working hard to expand the range of matters that can be heard by telephone as soon as possible. VCAT will contact you regarding your matter. However, should you require further information call 1300 01 8228 to discuss. See more

20.01.2022 The County and Supreme Courts of Victoria jury trials will be suspended from Monday.

20.01.2022 Precautionary closure of Sydney registry of the Family Court of Australia and Federal Circuit Court of Australia on 17 March 2020 due to COVID-19

20.01.2022 It’s time the state governments turn their mind to the private commercial leasing disaster of affected industries. We have tenants who can’t pay rent, and landlords who can’t pay mortgages.

20.01.2022 For all those interested in the current updates on commercial leasing in Victoria and the impacts of COVID19, this blog is essential.

20.01.2022 The reason action on climate change has stalled is vested interests borrowing straight from the big tobacco playbook, ALA spokesperson Greg Barns has told The N...ew Daily. ‘There are some analogies between the way in which the big pharma and big tobacco litigation emerged, where there was clear and unequivocal advice given to governments which said that radical action had to be taken.’ ‘For a government to deliberately ignore un-contradicted scientific evidence is gross negligence and could potentially lead to class actions against the government.’

16.01.2022 Can the Australians on board the Diamond Princess cruise which recorded 800+ #coronavirus cases and 7 fatalities sue Princess Cruises? As Victoria Roy of Stacks... 15.01.2022 Over 1,000 people have signed our petition calling on the Australian Government to #FundJusticeForChildrenNow by ensuring Youth Law Australia receives sustainab...le funding beyond 30 June. As that deadline approaches, we need your help to ramp up pressure by sending an email to the key decision-maker, Australian Attorney-General Christian Porter. You can use and modify an email we've already prepared here: http://bit.ly/2xNO4Mr

15.01.2022 By pressing ’55’ when calling Triple Zero, a person can request emergency help to their address without saying a word.

12.01.2022 Know the signs.

12.01.2022 Had the defendant been anyone else, it would be unlikely that the High Court would consider the appeal. However, Pell’s high profile could change that.

11.01.2022 In response to the COVID-19 coronavirus threat, we have been hearing that an increasing number of Courts are putting in place lawyers only mediations (with client instructions by phone). We have also heard that the County Court of Victoria is looking into conducting judicial resolution conferences online.

10.01.2022 Hopefully the hearing will be live streamed next week.

09.01.2022 The Government wants Australians to download a tracking and tracing app on their phones so that COVID19 restrictions can be lifted sooner. It is stated to be voluntary, however we question how voluntary it is given that it promises freedom in exchange.

08.01.2022 As a Disaster Legal Help Victoria partner, we join with Victoria Legal Aid, Federation of Community Legal Centres, Justice Connect and the Victorian Bar to prov...ide a legal response to bushfire relief efforts. 08.01.2022 Surely it would be in the public interest to discover all relevant documents relied upon to enforce a curfew on Victorians.

07.01.2022 Knowledge work that involves repetitive tasks or large amounts of data, such as lawyers’ often arduous document discovery process, is particularly ripe for disruption from AI, experts say.

07.01.2022 Justice v National Security The government should not be able to disappear people.

06.01.2022 The 2019 Human Rights Report Card from Australian Lawyers for Human Rights (ALHR) has shown some states and territories dropping significantly in their human ri...ghts performance for the year. While others flatlined in 2019, too few showed any improvement. Several key performance areas, such as disability, LGBTI and refugee rights also went backwards in 2019 when compared to 2018. https://alhr.org.au/alhr-2019-human-rights-report-card/ See more

06.01.2022 IBAC must be better funded so it carry out its fundamental functions.

05.01.2022 You might have heard recently that in the Supreme Court of the Netherlands, the government of the Netherlands was ordered to cut the nation’s greenhouse gas emi...ssions by 25 percent by the end of 2020. This signals the first time a nation has ever been required by its courts to take action against climate change. In an article published by The Conversation NJP Director George Newhouse explains why he doesn't think we in Australia could successfully do the same (although it would be great!)

03.01.2022 'Court representation provided by pro bono lawyers like Matt is critical for young, vulnerable people at risk of poor mental health on two levels. First, to be ...walked through each step as it happening helped Elei to better understand and approach her situation. Secondly, it was so valuable to have someone represent her and express her defence in a way she couldn’t herself.' Great example from Marrickville Legal Centre of how community legal centres play a critical role in providing legal assistance to young people that supports them getting back on track.

03.01.2022 The Federal Court found that "casual" workers who worked regular and predictable shifts with a firm advance commitment to work were not casuals despite how they were described in employment contracts and therefore were entitled to paid annual, sick and carer's leave.

01.01.2022 In early December NJP Director George Newhouse and Special Counsel Duncan Fine were privileged to meet with The Hon. Michael Kirby AC CMG, the former High Court... judge. Mr Kirby told them he was very impressed with the work of the NJP and gave us his full backing to keep fighting for the rights of people everywhere. 01.01.2022 From 30 June 2020, the Federal Government will discontinue funding our member centre Youth Law Australia. Youth Law Australia is the only state-wide community l...egal centre for children and young people in all Australian states - other than Victoria and Western Australia. It provides early intervention legal services in children’s matters, which help to prevent homelessness, violence, sexual abuse and online harms as well as other potentially dangerous outcomes.
