17.01.2022 I was asked this question one morning last week. How do you do represent people if you know they are guilty? My first response is always "I dont know whether they are guilty, I was not there!" ... Most people say fair enough. Then I explain a little more. The reality of life is that people make things up about other people, they exaggerate what may have happened, they provoke others into acting and force others into acting in self-defence. Those, and other things happen, and just because the police charge based on what someone says does not mean the accused person is guilty of crime. Whether someone has committed a crime is never as simple as just whether they acted and what they did. It is as much about "why" they did it, that is whether they had a guilty mind. If a person does not have a guilty mind, generally they cannot be guilty of a crime. That is where the accused persons story becomes relevant and an in-depth and experienced examination of the accuseds case needs to be conducted. After hearing both cases, in the event that a Magistrate or Jury have a reasonable doubt about either the acts or the guilty mind the accused person is alleged to have done or had, there is a finding of not guilty. Guilt is not for the police to decide, nor the accused persons lawyer. Both sides just advance their case as powerfully as they can. In my case, to establish that there is a reasonable doubt. 16.01.2022 Question posed tonight "Are police allowed to drug test people who are walking down the street?" The answer is "no". They have no power to do that. Does it stop them? 12.01.2022 I represented a young man on Appeal on April 15 this year and had his sentence of serving 3 months in prison set aside and he was released immediately. Page 18 of todays Couriermail reports the prosecution planning to appeal and "slamming" a judge for her ruling. Firstly, when I was a prosecutor I had respect for the Judiciary, always have and always will. It is appalling that the media are used to "slam" very senior members of our legal system. The prosecutors should jus...t appeal, instead they personally attack a particular Judge not even knowing or caring whether the Court of Appeal will agree with her. Secondly, the Judge got it right in setting aside the prison sentence because, as I say in the article, not every case is one calling for prison. My client was mentally ill at the time of the incident and remained so at the time of sentence. The result of the Appeal was just. 08.01.2022 There is one question I like to ask law students. It is "what do you think separates a good lawyer from a bad one?" I encourage them to speak from a clients perspective. Answers such as knowing the law and experience are the two top answers on the board. I say neither count unless your client trusts that you have both and that you will fearlessly apply your knowledge and experience to their case. You need to be a defendant to truly understand just how much trust you need in your lawyer. As lawyers we should always remember the trust our clients place in us.
