16.01.2022 VET FEE-HELP Student Redress Measures If you incurred a VET FEE-HELP debt because of inappropriate conduct by an education provider, you can apply to have your debt cancelled by making a complaint to the Commonwealth Ombudsman. VET Student Loans debts will not be considered under these measures.... What is ‘inappropriate conduct’? Under the redress measures, ‘inappropriate conduct’ includes: being offered an incentive (such as a laptop) to enrol even though the student had no intention of completing the course failing to provide accurate information about the course before the student enrolled, leading to the student enrolling in a course that wasn’t suitable and was different to what they believed not withdrawing a student’s enrolment when asked to do so by the student, leading them to incur a VET FEE-HELP debt. 14.01.2022 Guardianship reforms improve safeguards for vulnerable Queenslanders Attorney-General and Minister for Justice Shannon Fentiman said the new reforms make Queensland’s guardianship laws clearer, improve the efficiency of our guardianship system and have a more modern human rights focus.... "A significant change is the new improved enduring power of attorney and advance health directive forms replacing versions which had been in use for more than 16 years," Ms Fentiman said. Other significant amendments include: - changes to the general principles and health care principles that underpin Queensland’s guardianship legislation so they will be more consistent with the United Nations Convention on the Rights of Persons with Disabilities, and the Human Rights Act 2019; - clarifying and extending the current powers that the Queensland Civil and Administrative Tribunal (QCAT) can exercise where an attorney or administrator breaches their duties or obligations to improve accessibility to redress for victims of financial abuse; - a statutory exception to ademption to ensure that a beneficiary is not deprived of their entitlement under a will, just because the property they were entitled to was sold or disposed of by an attorney or administrator while the will maker was alive; and - providing QCAT with the jurisdiction to appoint administrators for missing adults. 02.01.2022 Don’t be caught out by online scammers when shopping this festive season The Office of Fair Trading are encouraging Queenslanders to check the business reviews and make sure their website is secure. Secure websites feature a closed padlock in the address bar or the address starts with ‘https://’ not ‘http://’. However, this could still be a scammer's website. Consumers should also always che...ck that they have legitimate contact details before making a payment or providing any personal information. Attorney-General and Minister for Justice Shannon Fentiman said if the product is faulty, or it doesn’t match the description you were given, you are entitled to a refund, replacement or repair, even if you have purchased online. If anything goes wrong with your online purchase, the retailer that sold it to you must provide a remedy. They cannot just direct you to the manufacturer, importer, or delivery company. It’s also worth remembering that if you paid via an online payment service or by credit or debit card, you may be able to reverse the transaction if there are issues with receiving the product. The Office of Fair Trading’s top tips for online shopping: Always check you are dealing with a reputable seller. You have the same rights as you would if you bought from a walk-in store. Check with traders what their cut-off dates are to guarantee pre-Christmas delivery. If products are faulty or do not match their description, the trader must fix the issue.
