22.01.2022 Not the best way to conduct yourself when dealing with Police. Police now have numerous statutory powers to stop and interact with the public. Namely, Licence and Drink Driving Powers. I normally point to my sign on the side of the car door stating I dont wish to answer questions, but not everyone can do that and youll raise their ire. Plus I can remain calm while they are shouting at me, while advising them they are being recorded.... Do you have to answer questions like where are going? No. Do you have to open the boot? Probably not unless they have reasonable grounds to suspect a crime. But they are used to getting their own way and lawyers are expensive. 21.01.2022 You may have heard the news that the Qld Govt is raising the penalty to $1000 for using a mobile phone. Firstly note, Police are exempt from such a deadly activity as purported by the powers that be. To be guilty you must have the device in your hand whilst moving or stationary but not parked.... People probably saw the SA Police handing out tickets to drivers using their phones to pay for food in the drive through in SA. You could argue you were parked, but that costs money. Drivers can also still continue to use cb or other two way radio. My advice, buy yourself a $20 phone holder and pay better attention on the roads to avoid this blatant cash grab from the government. Keep the phone holder out of the field of vision. 300 Use of mobile phones (1) The driver of a vehicle (except an emergency vehicle or police vehicle) must not use a mobile phone that the driver is holding in the drivers hand while the vehicle is moving, or is stationary but not parked. Penalty Maximum penalty20 penalty units. (2) In this section "mobile phone" does not include a CB radio or any other two-way radio. I cant comment on these matters as i havent time to read them fully. Most problems could be put down to being overworked. I believe the courts need a lower level jurisdiction to save costs and money for the public and to deliver faster decisions.
