15.01.2022 Speaking of delays, the Sydney Family Court registry advised our staff last week that consent orders are taking 10 weeks to be approved. That means orders are unlikely to be made before the courts break at the end of the year. This is for parties who agree. For those who dont agree and require judicial determination, the final outcome is much longer. Its not unusual for contracts to include a Special Condition to allow the vendor to use the deposit in the sale of their property for the purchase of another property, and sometimes there are different variations of this clause embedded in the Special Conditions. If you are a purchaser and do not want your deposit to be used by the vendor prior to settlement, talk to your lawyer or conveyancer to negotiate the removal of this clause from the Contract of Sale.
