And they are especially in the court room when fighting trade mark infringers from the fashion industry. Harley-Davidson and Hells Angels are both giants in the world of motorcycle enthusiasts, but their presence in the fashion arena should not be under-estimated.... They each offer a range of trade marked fashion clothing uniquely identifiable to their brand. When fashion retailer, Alexander McQueen, was caught using the Hells Angels death head skull logo in 2010 without permission, Hells Angels successfully fought the illegal use in court, culminating in McQueen losing thousands of dollars’ worth of unusable merchandise. Urban Outfitters similarly suffered the wrath of a Harley-Davidson lawsuit in 2014. He first patented the DABUS (Device for the Autonomous Bootstrapping of Unified Sentience) in 2008, a system which uses two deep neural artificial intelligence pathways working in tandem to check and counter-check for creativity, usefulness and uniqueness to autonomously create purposeful, functional, patentable designs. In 2020, Dr. Thaler made patent applications to the UK, Europe and US Patent Offices for two inventions his DABUS had created, but both were unanimously rejected. Although it was agreed that the objects created were patentable, and that DABUS had solely created them, patent law across the world states that only a natural person may be granted a patent. The use of AI for such purposes exposes a grey area over ownership that, internationally, current patent law is inadequate to service.
