24.01.2022 The New South Wales government announced that from 1 August 2020, first home buyers will be exempted from the payment of stamp duty in the following categories: 1. Buying a new home for $800,000 or less (threshold increased from $650,000 to $800,000). 2. Buying a vacant land for $400,000 or less (threshold increased from $350,000 to $400,000).... There are concessions which apply for payment of stamp duty in each of the above category. Please note that the changes to the threshold apply to newly built homes and vacant land only. The changes do not apply to existing homes. The changes will only operate for 12 months from 1 August 2020. The state government will continue to offer a $10,000 first homeowner grant for those who are buying their first home for not more than $600,000 or buying a house and land package for not more than $750,000. 21.01.2022 Judgment Just In: The Supreme Court has found Mr Warwick guilty of 20 counts, including three counts of murder, for a series of events which occurred between 1...980 and 1985 which were linked to his matter before the Family Court of Australia. The Supreme Court was satisfied beyond reasonable doubt that Mr Warwick was responsible for the following: the murder of Justice Opas in 1980; the bombing of the home of Justice Gee in 1984; the bombing of the Family Court building in Parramatta in 1984; the bombing of the home of Justice Watson in 1984 (causing the death of Mrs Pearl Watson); the attempted bombing of Mr Tall’s car in 1985; and the bombing of the Kingdom Hall of the Jehovah’s Witnesses at Casula in 1985 (causing the death of Mr Graham Wykes). 03.01.2022 In this case, the NSW Court of Appeal decided that the applicants (workers) are entitled to weekly benefits after the 260 weeks limit as their injuries exceed 20% Whole Person Impairment. It is irrelevant as to whether the assessment of the injuries was done prior or after the 260 weeks limit. Justice Simpson says:... "It is necessary to go no further than the text of s 39 to resolve the present dispute. Nothing in any of the three subsections of s 39 states, explicitly or implicitly, that removal of the subs (1) bar is dependent upon the date of the assessment of the degree of permanent impairment as distinct from the existence of the degree of permanent impairment. The language of subs (2) points in the opposite direction: the foundation for the removal of the subs (1) bar lies in the existence of a degree of permanent impairment exceeding 20%. Subsection (3) does no more than specify the mechanism by which the degree of permanent impairment is to be assessed; nothing in subs (3) suggests that an assessment may only be prospective. If it were necessary to go beyond the text of s 39, resort to principles of statutory construction would support the same approach: at [90]-[91]."
