24.01.2022 Recently, I ran a mediation where we reached agreement in a record 30 minutes. Why was this such a quick and easy mediation? The answer lies in the land of plain language. It was a landlord/tenant rent relief dispute. The tenant had sought rent relief from the landlord but was not satisfied with the offer. Except, the tenant was actually happy with the offer when it was explained face to face. The offer had only been communicated to the the tenant via a letter from the... landlord's lawyer. The tenant said in the mediation that "I read the letter but it was from a lawyer and I didn't understand it. I wanted to protect myself with the mediation option." The mere fact that it was a letter from a lawyer meant the tenant didn't feel that they could call to discuss the contents. A quick call could have resolved the matter and save the parties (and taxpayers) time, stress and money. A quick phone call at the first signs of a dispute can often prevent escalation.
