25.01.2022 Do you recall this case of ours from earlier this year? http://www.dailymail.co.uk//Victorian-woman-denied-right-b Well the Childrens Court has issued a new practice direction extending the requirement for DHHS to file their notes in apprehension cases to regional as well as city courts. ... For some reason the requirement for DHHS to provide procedural fairness to parties through pre-hearing disclosure of notes up until now has only been required in city courts. The injustice of this played out spectacularly in a case I ran to the Supreme Court earlier this year (referred to above) where the non-disclosure of notes led to a newborn being removed from her parents care, forceably and irretrievably weened from her mothers milk, and passed through 3 separate placements only to be returned to her parents 10 days later after the full contents of the DHHS notes were revealed to the parties and the court. This important reform, which we lobbied for following the case, should go some way towards addressing the enormous postcode injustice which occurs in the removal of children by the DHHS in regional areas. http://www.childrenscourt.vic.gov.au//Practice%20Direction

We find that often police themselves dont know the law, especially if the law is being updated on the run, and charges are laid, including infringements, without those charges being able to be sustained when the case reaches court. Examples from this article such a mountain biker and a m...an using the carwash (infringements withdrawn after publicity) are examples of this.
