04.01.2022 - Further to our earlier post, the Department have formally amended the legislation to enable Hong Kong passport... holders to stay on a 485 visa for 5 years. The legislation commenced retrospectively on 9 July 2020 and the provisions will be applied until 8 July 2025. For the 485 visa to have the 5 year duration, the primary visa holder must have held a Hong Kong (SAR) passport when their 485 visa was granted. Individuals who are secondary family members will also have the 5 year visa duration regardless of what passport they hold. TSS visas and 485 visas which were granted from 9 July 2020 onwards will have a 5 year validity period where the primary visa holder held a Hong Kong (SAR) passport holder.
