09.01.2022 CORONAVIRUS - Now a Pandemic How does this impact Business Insurance Policies: The SARS outbreak in 2003 contributed to policy changes. In 2003 policies did specifically insure against losses arising from disease, but many of those extensions have been deleted since that time.... Policy exclusions include any infectious animal or human disease, while limitations based on notifiable disease would now be in effect for the coronavirus. Business Interruption cover also requires triggers such as property damage also. In Australia BI cover usually covers physical damage or loss to the property. In normal circumstances there is usually an exclusion for pandemics i.e. COVID-19. While some claims could be accepted, it remains unlikely that BI cover will support claims made by businesses in relation to the current coronavirus pandemic. However, recently the Australian Financial Complaints Authority (AFCA) advised that they will be taking a 'test case' to the Federal or Supreme Court to 'test' whether the BI exclusions of some insurers can be relied upon to deny claims.
