21.01.2022 We appeared for our client in the Parramatta Local Court in relation to very serious charges, mainly under s37(1A) relating to Intentionally choking person without consent and section 59(1) of the Crimes Act 1900 NSW relating to Assault occasioning actual bodily harm in relation to Domestic Violence. Both charges carry a maximum jail term of 5 years and as an international student, our client was subject to possible deportation and visa cancellation under s501 of the Migrati...on Act 1958. After a substantial submission and arguments in court, we manage to Dismissed and withdrawn all charges against our client including withdrawal of ADVO. Very stressful for the client due to the nature of the offence and charges, but happy with the result. Mission accomplished.

05.01.2022 Today we appeared for our client at the Burwood Local court who was charged with Section 61 of the Crimes Act 1900 related to a common assault which carries maximum imprisonment for two years and Charged with s 13(1) (5) of the Crimes ( Domestic and Provisional Violence ) Act 2007 relating to, intended fear, intimidate, and attempt to stalk. This carries a maximum sentence for up to five years. With the help of lengthy submission, negotiation with the prosecutor and character references, we manage to avoid the jail term and conviction for the client Another excellent result for the client considering the seriousness of the charges and allegations.

04.01.2022 Judgment Just In: The Court of Appeal has allowed in part an appeal from the Supreme Court, holding that while the primary judge had erred in declaring that four sisters indefeasible title to property was held on trust for their brother due to its being knowingly obtained in breach of fiduciary duty, the sisters were nonetheless liable to account for the value of the property. The Court further held that the primary judge was correct to find that the solicitor acting on the transaction owed the brother, as beneficiary of a testamentary gift of the property under a prior will, a common law duty of care to protect the testators intention, and that breach of duty and causation were also established.
