23.01.2022 MLC Life pays AFL footballer’s $1.4 million claim MLC Life has paid a $1.4 million total and permanent disability (TPD) insurance claim to former AFL player Shaun Smith for brain damage caused by match concussions. In a statement, the insurer says it received Mr Smith’s TPD claim in April.... Following our assessment of his medical and employment circumstances we were pleased to admit his claim and make payment to his superannuation fund, the insurer said. In reaching our decision, we considered the opinions of Mr Smith’s doctors about the impact of his medical condition and ability to return to work in the future and we were satisfied that Mr Smith met the relevant definition of TPD in the insurance policy. Mr Smith, 51, who played for North Melbourne and Melbourne, told ABC News the historic payout could make people take concussion in the sport more seriously. He says his brain injury affected his moods and damaged his memory. I’m a pretty easy-going guy, and I was getting pretty angry at the drop of a hat, he told the ABC. Then I started forgetting a lot of things my short-term memory especially was not flash. It doesn’t make it much fun for people living around me. The AFL Players’ Association told insuranceNEWS.com.au it is pleased Mr Smith was able to access significant financial support through an individual insurance policy he bought many years ago. The players’ group insurance through superannuation is currently provided by Resolution Life, but players have the option to decide the best policy for their individual situation, GM Legal and Player Affairs James Gallagher said. A high-profile clergy abuse survivor, gagged under new laws in Victoria, is finally able to speak out again under his real name.... Phil Nagle has spent the past few decades campaigning for clergy abuse survivors and was identified in the media hundreds of times before the Victorian laws took away his right to self-identify. Mr Nagle is the first male survivor in Victoria to win the right to self-identify in media. Under the new state laws quietly introduced in February victims can no longer speak to media under their real names, in any case where the offender has been found guilty. The only exception is if they obtain a court order a process which can cost thousands of dollars. Speaking to news.com.au this morning, Mr Nagle said he had the court order sitting in front of him and couldn’t believe it. Mr Nagle said it was often underestimated how beneficial it is to have spokespeople advocating for sexual abuse survivors particularly clergy abuse survivors. If we didn't talk about it back then, what was going on in the Catholic Church, it would still be going on now, he said. I’m just very relieved, excited yes, but certainly relieved. To be gagged after all this time was incredible. Mr Nagle said other survivors of sexual abuse in Ballarat who have also been gagged under the laws, were elated for him after hearing the news. Hopefully we get some more of those other survivors over the line to self identify, he said. I’m pretty excited to be able to self-identify again, it’s a very important thing, he said. 18.01.2022 SA fixed traffic camera system thrown into question after motorist’s successful Supreme Court appeal A decision handed down by the South Australian Supreme Court may pave the way for other motorists to appeal their red light tickets. South Australia’s fixed traffic camera system has been thrown into question after a driver successfully appealed his red light fine in the Supreme Court.... David Woolmer was booked for running a red light arrow at Beulah Park, east of the CBD, in March 2018. The Magistrates Court upheld the fine, but Justice Greg Parker overturned it on the basis that the camera had never been legally tested. In a judgment handed down last week, he said regulations required the cameras to be tested with cars crossing through the intersection on a red light. He ruled that the camera had not been checked in line with those requirements. I am satisfied on the balance of probabilities that the appellant has provided proof contrary to the facts asserted in the certificate, Justice Parker wrote. I uphold the appeal and quash the finding of the magistrate... I quash the appellant’s conviction. The decision may pave the way for other motorists to appeal their red light tickets using the same argument. When a fine is challenged in court, a Certificate of Testing and Operation can be produced to prove the legitimacy of the infringement. The lower court had accepted the police argument that it was impossible to safely conduct testing that captured cars breaking the rules. The judge said it would be possible, however some rules may need to change. I doubt the correctness of the suggestion by the respondent that it may not be possible to amend the regulations or the Australian Road Rules to authorise police to commit what would otherwise be an offence to facilitate testing of photographic detection devices, he said. Two people are fighting for their lives after being hit by cars while crossing the road in two separate incidents in Brisbane on Wednesday. Shortly after 4pm, a 27-year-old woman was hit by a car as she attempted to cross Stanley Street East in East Brisbane. While the driver of the vehicle was not injured, the pedestrian was transported to the Princess Alexandra Hospital with life-threatening-injuries. An hour later, police were called to Lutwyche Road, where a 26-year-old man was hit by a car as he left a hotel and crossed the road. Police said the man was attempting to cross the southbound lanes when he was struck before colliding with a second vehicle which had stopped at traffic lights. He was taken to the Royal Brisbane and Women’s Hospital with critical injuries. The 34-year-old male driver of the first vehicle was taken to hospital and treated for shock. Police are calling for witnesses or anyone with dashcam footage of either of the areas at the time of the incidents to come forward. The collapse happened at a residential building whose wall was exposed to a building site. A Fire and Rescue NSW spokesman said the building appeared to have been undermined by groundworks.
