14.01.2022 Thinking of standing down your employees due to COVID-19....? Firstly and very generally speaking, employees can only be stood down without pay if they cant be usefully employed because of a stoppage of work for any cause for which the employer cant reasonably be held responsible. Also very generally, an economic downturn is unlikely to be sufficient to stand down employees by itself!... So here are three big RED FLAG areas we look at when asked this question - given the legislation for many businesses still has a high bar in place to prove this action is lawful. 1) Is there a government direction affecting you or your supply chain (e.g. a gym, cafe etc)? 2) Employees are READY and WILLING to work but are they ABLE to (including redeployed elsewhere like home)? 3) Have you consulted with / notified employees? The first step to address a stand down is... Check *your* individual facts and dont assume your business is like the next. If youre a National System employer, contact the Fair Work Ombudsman. If youre a State System employer, contact Wageline. And ask your accountant about the suite of government incentives coming. These could help you avoid a minefield altogether.
