18.01.2022 How important is your duty to disclose? In a matter that was finalised in 2015 and saw the wife receive a $15 million property settlement, the wife has now sought to reopen on the basis that a "miscarriage of justice" occurred. Specifically, that the husband failed to disclose his substantial interest in a company which resulted in him receiving a financial benefit. A benefit to the tune of $93 million. ... When dealing in property matters, both parties have a duty to disclose their financial circumstances to the other party. It is vital that you comply with this obligation to the best of your abilities. Contact our office today to see how we can help you understand the ins and outs of financial disclosure.

07.01.2022 Lawyers in Brisbane are taking the law into their own hands, literally! A mediation pilot ran over three days and saw a rotating group of lawyers give their time to mediate a select set of 17 matters, covering both parenting and property disputes. The hope of the pilot was to offer alternatives to resolve matters quickly. There are 350 new matters filed every month in the Brisbane Federal Circuit Court of Australia alone. This is a total rise of 7.5% matters awaiting some fo...rm of hearing each year. While Queensland continues to call out for 2 more judges, practitioners such as Barrister Bruce Thiele have jumped in to meet the need. Donating two days to assist in the pilot, Thiele identifies more can be done by those on the front line, "For me personally, it's me being part of the solution rather than just continuing to complain". While the concept was great, the results were better. Of the 17 cases, 10 of those settled. That is a 59% success rate with the pilot in its first year. "The family lawyers I have dealings with agree that compassion, cooperation and consideration should drive us throughout the divorce process. Ultimately our duty is to the court and to the child, first and foremost."
