21.01.2022 The Problem with some "No Win No Pay" Lawyers. So I recently put together a legal framework to help a client who was being sued for $250k, along with a few other companies. Basically a young lad on a construction site had stepped outside the scaffolding because climbing down safely was not satisfactory for him. Of course he fell and injured himself.... My client was being held responsible for not "holding his hand", despite safety training, SWPs, supervision etc. Here lies the problem. Whilst we won and my client was completely released, it looks like the court may have awarded some damages from the other companies or at least from WorkCover. --- A WIN--- But certainly not enough to cover all the legal expenses that were being charged by his "lawyers". A WIN is a win and so the legal costs are passed on to the youngster who may now have a significant debt. No Win No Pay may seem like a great option, but consider that your legal expenses may reach $$$$$ and you have only been awarded $............ but it's still a win and you must pay.

21.01.2022 The Staff Christmas Party Predicament! It is the best of times and the worst of times; the marvels of the Staff Christmas Party. Every year the scandalous stories regarding who was behaved, who was cheeky and who was the outrageous surprise of the year make their way to the monuments of workplace history. Work parties certainly embrace the wonder of Christmas cheer until, that is, someone is injured. These incidents ruin a great party but can also become a WorkCover or lega...l nightmare. So instead of cancelling your party for fear and panic of the nasty, there are a few simple hints to help you preserve the Christmas Spirit whilst enjoying safe and happy outcomes. 1. Living up the party with team building games a good DJ or party venue will have activities and competitions that entertain whilst increasing worker bonds and morale. 2. When everyone is busy playing fun games and competitions you can have a smaller alcohol budget (or none at all) that shows your responsible attitude toward social etiquette. 3. Make it short. A long party is expensive and increases the likelihood of party blues. 4. Supply transport if possible do not allow any drinking then driving. 5. Definitely remind workers that under the new Safety Legislation they are also responsible to look after their own safety and the safety of their colleagues. 6. And finally, have a very Merry Christmas. I love Christmas parties and I do hope yours is the best and the safest. 16.01.2022 New Industrial Manslughter Laws. The maximum penalty for the new offence is 20 years imprisonment for an individual, with a maximum fine of $10 million for a corporate offender. A person can also be charged with manslaughter and prosecuted under the Queensland Criminal Code for a workplace fatality. Manslaughter is the unlawful killing of a person without the intention of causing the death or grievous bodily harm of the person.... However, industrial manslaughter adds another dimension to punishing guilty people or entities. The offence is outcome focused and applies where a worker actually dies (or is injured in the course of carrying out the work and later dies of that injury). In these circumstances, the persons conduct must cause the death of the worker and they must be negligent in causing the death of the worker by their conduct. Stay Safe.

05.01.2022 Head up everyone in construction. This may flow through to other states shortly. Building and construction companies using or erecting scaffolding will be targeted by WorkSafe ACT inspectors this month as the regulator focuses on reducing the number of injuries and deaths related to falls from heights.... Since 2014 there have been 476 claims for workers compensation in the ACT relating from falls from heights, which is 476 injuries too many, said Work Safety Commissioner Greg Jones. He said this audit was critically important to ensure safe practice because falls from heights were one of the most common and debilitating accidents that can happen in a workplace. Even a two metre fall can cause serious injury or be fatal. We know that falls are the leading cause of death in construction every year. These deaths are preventable and we want to work with industry to ensure we are all actively preventing serious accidents through delivery best practice, Mr Jones said. Scaffolding, when used appropriately, is an integral part of safety for those working at heights. But if scaffolding is not used safely, it can be dangerous to workers. During March and April, the audits will include the inspection of commercial and residential construction sites. We will be working to educate as well as ensure compliance with industry during this proactive audit, said Mr Jones.
