24.01.2022 What is a cooling off period? When purchasing a residential property in NSW, once the contracts exchange you have a 5 business day period to withdraw. You can deem a longer or shorter cooling off period in the contract, this must be agreed upon. ... 01.01.2022 With summer fast approaching property buyers like to add a pool to their wish list. It’s important to note that if your selling a property with a pool you must have council or a certified pool inspector conduct an inspection of your pool or spa. They will then issue a Certificate of Compliance or a Certificate of Non-Compliance which must be annexed to the contract or you risk the buyer being able to get out of the contract within 14 days from exchange. The buyer must c...omply with any non-compliance the pool or spa may have within 90 days from settlement at their own cost. If your pool or spa is deemed a serious safety risk you will be required to comply with such non-compliance immediately at your own cost rather than wait for a buyer. For buyers, it is a situation where they must satisfy themselves as to the costs and work involved to make the pool or spa comply if a certificate of non-compliance is not available.
