07.01.2022 We certainly think outside the square. I currently have a client who blew 0.151%, disqualifying him from applying for a restricted license and imposes a mandatory disqualification for 12 months, here in Tasmania, which I believe and stand to be corrected, is the same in other States & Territories in Australia. We've entered a NOT GUILTY PLEA and his Hearing is in January 2020.... If I'm successful, he gets back his full driver's license and the certificate showing his 0.151% breath test will be inadmissible, irrelevant and client will be returned his driver's license without any penalty or condition. If I'm unsuccessful, he remains disqualified for the mandatory 12 months, which doesn't affect him because his license has already been taken off him after the 0.151% reading at the Police Station, which we're now challenging. I told him, he was already looking at a mandatory 12 months disqualification, but if there was a 10% chance, take it, which we are doing in his case, especially when he has 3 jobs to maintain, requiring his driver's license, a mortgage to service and a pregnant wife, with a child on the way. We think outside the square and I'm confident we will get a successful outcome! If you think this may also apply to your situation, let me know?
