21.01.2022 Recent decision of NSW Court of Criminal Appeal: 'I never smelled any weed your Honour'... Andrija Mesterovic was convicted in 2015 of knowingly participating in the commercial cultivation of cannabis plants. He had been caught transporting items associated with the cannabis cultivation, although he denied knowing that the house where the cultivation occurred was being used for that purpose. A jury found Mesterovic guilty. He then brought this appeal claiming (in part) that p...olice evidence of the house having a "very, very strong" smell of cannabis had not been foreshadowed, and that he had therefore suffered prejudice because if he had known of that police evidence in advance he could have brought evidence that his "long history of chronic sinusitis" had affected his sense of smell. However, the Court of Criminal Appeal was not convinced that chronic sinusitis would necessarily have meant Mesterovic could not smell the cannabis in the house, and said Mesterovic could "easily" have obtained relevant evidence during the trial if the issue was considered pertinent. Leave to appeal refused on all grounds. (Mesterovic v R [2016] NSWCCA 140 - 15 July 2016). See more

Coming soon after the Nice truck massacre, a low-tech terror attack in Southern Germany involving an axe again shows how vulnerable we are to being killed and maimed by individuals using ordinary items against us. AFP reports today that a 17 year old man has just injured up to 21 people using an axe on a train.



09.01.2022 Eddie Obeid in the news again today about 'new' criminal charges... More bad news for former New South Wales cabinet minister Eddie Obeid, as Sydney Morning Herald reveals that Obeid and son Moses have been charged over a $30 million "windfall" they made from a coal deal at Mount Penny. Obeid has already been convicted in relation to other corrupt business dealings, and at 72 he won't be relishing the prospect of several years locked behind bars. He'll be keeping his lawyers busy for a while yet it seems.
