05.01.2022 A young bright girl fell into the trap of the drug traffickers and was caught. Pleaded guilty to knowingly participating in a drug syndicate, and was sentenced ...3 years imprisonment. In captivity she gave birth to a baby girl. Under section 501(04) of the Migration Act of Australia 1958, her permanent visa was cancelled and an appeal to revoke the decision was rejected. She was facing deportation to Vietnam with a young child. We took the matter to AAT general division and matter was heard last week in a full day hearing via video link. Today we received the result. 02.01.2022 Great finish to the week, client had been with me for last five years. When he came he had applied for protection visa, I took over his case, immigration errone...ously refused protection visa owing to miscommunication on part of Department of immigration, I wrote to immigration and they revoke their decision (happen rarely because if there is a decision immigration do not revisit it but you have to go to AAT, luckily for us, Department revoked its own decision and application stood valid awaiting determination and no impediment of schedule 3) subsequently applicant married and I advised him to withdraw the application for protection visa. He was not ready to lodge application for partner visa at that time however, reluctantly he agreed to withdraw, lodged partner visa after that and here comes his permanent residency. See more
